Legal Aspects of Homoparentality

Abstract:

Homoparentalita je existující fenomén, který vzbuzuje ve společnosti rozporuplné emoce a názory. Legislativa odrážejíc postoj veřejnosti homoparentální rodiny vnímá jen okrajově. Neposkytuje jim taková práva a neurčuje jim povinnosti, které jsou typické pro rodiny heterosexuální. Postavení homoparentální rodiny v současném platném právním řádu, práva a povinnosti jednotlivých členů rodiny, vývoj právní úpravy registrovaného partnertsví jako institutu tvořícího základní buňku pro vznik homoparentální rodiny a další témata včetně lidkosprávních aspektů jsou obsahem práce. Nemalá část je taktéž věnována analýze stavu homoparentality a právní úpravy postavení stejnopohlavních párů v zemích Evrospké unie.

Abstract:

Homoparentality stands for phenomenon of few past years. Legal recognition of the formal union between two women or two men is the first and the most important step towards the legal recognition of the same-sex family. Formal union is ussually called registred partnership or same-sex partnership. Registred partnership in the Czech legal order grant several rights and also means several restrictions. The analysis of the Czech legal order shows that there is a different care of heterosexual family and a homosexual family. For example in the tax sphere, adoption, alimony rights, spousal privilage and more. On the other hand there is the same access to the social security for any type of the family mentioned above. In the European Union there are some states that recognize the same-sex marriage (for example Denmark, Netherlands, Spain). Partners entering into marriage have the same rights as opposite-sex partners in all fields of law and living. It concerns rights to adopt child of the partner, alimony rights, right to access the assisted reproduction process and so on.
