Práce se zabývá právní úpravou držby a právních následků s tímto institutem souvisejících, která v souvislosti s přijetím zákona č. 89/2012 Sb., občanský zákoník, doznala zásadních změn. Postupně je v práci rozpracován jak samotný pojem držby, tak i problematika druhů držby, vzájemných vypořádacích vztahů mezi držitelem a subjektem práva, dále též ochrana držby a vydržení.
