The Principle of Subsidiarity of Criminal Repression

Abstract:

Diplomová práce se zabývá zásadou subsidiarity trestní represe a jejího projevu v principu ultima ratio, respektive uplatnění zásady v rozhodovací praxi soudů a jiných subjektů. Teoretická část vymezuje koncepci zásady subsidiarity trestní represe od historických souvislostí, až po její uplatnění v Ústavním pořádku ČR. Nedílnou součástí diplomové práce je analýza trestního zákoníku, především ustanovení týkajícího se legální definice trestného činu. V rámci této kapitoly se diplomová práce věnuje rozboru ustanovení § 12 odst. 2 trestního zákoníku, které definuje zásadu subsidiarity trestní represe jako materiální korektiv a ustanovení § 13 odst. 1 trestního zákoníku, týkajícího se formálního pojetí trestného činu. S výše zmíněnými ustanoveními úzce souvisí uplatnění zásady subsidiarity trestní represe s ohledem na stanovení společenské škodlivosti, která určuje závažnost spáchaného trestného činu a případné použití prostředků trestního práva jako ultima ratio k ochraně práv a společenských zájmů. Teoretická část je zakončena projevem zásady subsidiarity trestní represe v trestním zákoníku, v oblasti trestního práva procesního a zákoně o soudnictví ve věcech mládeže. Praktická část diplomové práce věnuje pozornost rozboru stanoviska trestního kolegia Nejvyššího soudu, které podává ucelený výklad k ustanovení § 12 odst. 2 trestního zákoníku a také rozboru vybraných nálezů Ústavního soudu a judikatury Nejvyššího soudu. Poslední kapitola diplomové práce zkoumá možné účinky zásady subsidiarity trestní represe v budoucích kodifikacích, podává úvahy de lege ferenda a autorovi osobní názory ohledně budoucnosti uplatnění zásady subsidiarity trestní represe. V závěru práce shrnuje veškeré poznatky zjištěné při jejím zpracování a konstatuje, zda došlo k naplnění cílů stanovených v úvodu diplomové práce.

Abstract:

The thesis deals with the principle of subsidiarity of criminal repression and its manifestation in the principle of ultima ratio, or the application of the principle in the decision-making practice of courts and other entities. The theoretical part defines the concept of the principle of subsidiarity of criminal repression from the historical context to its application in the Constitutional Order of the Czech Republic. An integral part of the thesis is the analysis of the Criminal Code, especially the provision concerning the legal definition of a criminal offence. Within this chapter, the thesis analyses the provisions of Article 12(2) of the Criminal Code, which defines the principle of subsidiarity of criminal repression as a material corrective, and the provisions of Article 13(1) of the Criminal Code, concerning the formal concept of crime. Closely related to the above-mentioned provisions is the application of the principle of subsidiarity of criminal repression with regard to the determination of social harmfulness, which determines the gravity of the offence committed and the possible use of criminal law means as an ultima ratio to protect rights and social interests. The theoretical part concludes with the manifestation of the principle of subsidiarity of criminal repression in the Criminal Code, in the field of criminal procedural law and in the Juvenile Justice Act. The practical part of the thesis focuses on the analysis of the opinion of the Criminal Chamber of the Supreme Court, which provides a comprehensive interpretation of the provisions of Section 12(2) of the Criminal Code and selected rulings of the Constitutional Court and the case law of the Supreme Court as well. The last chapter of the thesis examines the possible effects of the principle of subsidiarity of criminal repression in future codifications, provides de lege ferenda considerations and the author's personal views on the future application of the principle of subsidiarity of criminal repression. The thesis concludes by summarising all the findings of the thesis and concludes whether the objectives set out in the introduction to the thesis have been met.
