Legitimate Expectations Principle in Public Administration Practice and Judicial Review

Abstract:

Principy dobré správy jsou v ucelené formě coby základní zásady činnosti správních orgánů obsaženy v § 2 – 8 zákona č. 500/2004 Sb., správní řád (dále jen „správní řád“). Jednou ze nejvýznamnějších zásad je princip předvídatelnosti obecně označovaný jako ZÁSADA LEGITMNÍHO OČEKÁVÁNÍ, obsažená v ustanovení § 2 odst. 4 in fine správního řádu. Tato bakalářská práce přináší širší náhled na zásadu legitimního očekávání v kontextu ostatních principů dobré správy, přičemž práce se nevyhýbá ani drobnému historickému exkurzu, osvětlení pozice zásady legitimního očekávání v evropském a angloamerickém právním systému, včetně detailnějšího rozboru projevu této zásady v německém správním právu. Obsahem práce je určitá analýza právního stavu de lege lata, přičemž těžiště práce odhaluje aplikaci, respektive absenci aplikace této zásady ve správní praxi určitých oborů veřejné správy v České republice, přičemž současně přináší pohled na již ustálenou judikaturu správních soudů. Součástí této práce je i vyjádření názoru autora směrem k právní úpravě de lege ferenda, jakož i část zabývající se názory a pohledy odborníků na zásadu legitimního očekávání.

Abstract:

The principles of good administration are recently codified in our legal system in a comprehensive form as the basic principles of operation of the administrative authorities in sections 2 – 8 of the Act Nr. 500/2004 Coll., Administrative Procedure Code (hereinafter the „Administrative Procedure Code“). One of the most important principle is the principle foreseeability genearally referred to as the PRINCIPLE OF LEGITIMATE EXPECTATION, which is included in provision of section 2 paragraph 4 in fine of the Administrative Procedure Code. The banchelor thesis brings a broader view of the principle of legitimate expectation in the context of the other principles of good administration while it also includes a short historical excurcus, explaining the position of the principle of legitimate expectation in the European and Anglo-american legal systems, including a detailed analysis of expression of this principle in the German administrative law. The content of the thesis is an analysis of the law de lege lata while the centre of the thesis discloses application, respectively the absence of this principle in the administrative practice of certain areas of administratation in the Czech Republic. At the same time the thesis brings a view of the established case law of the Administrative Courts. Part of this thesis is also the author’s opinion on the law de lege ferenda as well as the point of view of the specialists in administrative law regarding the principle of legitimate expectation.
