Domain names and domain names disputes in ADR

Abstract:

Tato diplomová práce se zabývá řešení sporů vznikající z kolize doménových jmen s právy třetích osob v českém právním prostředí. Důraz je kladen na řešení sporů formou online řešení sporů domén .cz, který byl v České republice zaveden v roce 2015. Úvodní část této práce rozebírá pojmy vázané na problematiku domén a doménových jmen, je tedy nastíněno základní fungování a role domén a doménových jmen v internetové síti. Mimo jiné je v této části popsána struktura domén, zásady přidělování, principy a zásady související s užíváním domén a doménových jmen, správa doménových databází, tvorba i vznik doménových jmen. S ohledem na následující kapitolu je v úvodní části popsána i právní povaha doménových jmen v českém právním řádu. Druhá část se zaměřuje na výčet sporů a kolizí doménových jmen s jinými právními instituty. Poměrně podrobně je definován cybersquatting a kolize doménových jmen s ochrannými známkami, které jsou do dnešní doby nejčastější příčinou vzniku doménového sporu. V třetí části se práce zaměřuje na alternativní řešení sporů z hlediska obecného, kdy na základě obecné definice pojmu je popsáno fungování alternativního řešení sporů z doménových jmen na úrovni generických doménových jmen a na úrovni národní domény .cz. V poslední zvláštní části práce se zaměřuje na praktické otázky vedení sporu dle Pravidel řešení sporů doménových jmen domény .cz, kde jsou vymezeny i kroky advokáta, popř. navrhovatele před samotným zahájením řešení sporů z doménového jména. Postupy řešení sporu z doménových jmen jsou v této části postupně srovnávány s postupem v civilním řízení v souladu s občanským soudním řádem. Tato část je koncipována jako teoretický návod při podávání návrhu na zahájení řešení sporu. Neklade si však za cíl zkvalitnit nápovědu, která je správcem sporu uveřejněná na jeho oficiálních stránkách. Závěrečná část se obsahuje praktické rady, nástroje a postupy, které lze uplatnit před podáním návrhu, při vkládání návrhu na on-line platformu správce sporu a také postup po vydání rozhodnutí.

Abstract:

This thesis deals with the dispute resolutions arising from the conflict of domain names with the rights of third parties in the Czech legal environment. Emphasis is placed on the dispute resolution through the online dispute resolution of domains .cz, which was introduced in the Czech Republic in 2015. The introduction of this work analyzes the terms related to domains and domain names, to the basic functioning and role of domains and domain names in the internet network. Moreover, this section describes domain structure, allocation principles, principles related to domain and domain name registration and usage, domain database management and creation of domain names. With regard to the following chapter, the legal nature of domain names in the Czech legal system is described in the introductory part as well. The second part focuses on the enumeration of domain name disputes and description of collisions with other legal institutes. Cybersquatting and the disputes related to domain names with trademarks, which are the most common cause of a domain dispute to date, are defined in detail. In the third part, the thesis focuses on alternative dispute resolution providing the general definition of the term that describes the functioning of alternative dispute resolution of domain name disputes at the level of generic domain names and the national domain .cz. The last part of the thesis focuses on practical issues of the process of litigation according to Rules of Domain Names Registration under the .cz ccTLD. The steps of the attorney and of the petitioner prior to the initiation of the settlement of domain name disputes are described. The procedures for domain name disputes resolutions are gradually compared with the procedure of civil proceedings in accordance with the Czech Code of Civil Procedure. This part is conceived as a theoretical guide of submitting a proposal to initiate a dispute resolution. However, it does not aim to improve the quality of the instruction material that is posted on the official website of the dispute resolution by the Czech arbitration court.
