Activity of court and notary as a court commisioner in protabe proceeding

Abstract:

Bachelor's work deals with the theory of inheritance law, its principles, functions, assumptions and the history of succession proceedings and acts carried out by the Court below, and the notary as a court Commissioner in this proceeding. Part of the work of the Court and the judicial Commissioner of the activity of the notary as are focused on their scope and operations carried out before the commencement of the proceedings, in its course, but after the succession too. The aim is the theoretical elaboration of the inheritance law and theoretical analysis of the activities of the Court as a judicial Commissioner in proceedings and notary of inheritance. These targets through the deskription method using the comparative elements, through available resources. The result is a coherent context theory of inheritance and the activities carried out by it in.

Abstract:

Bakalárska práca sa zaoberá teóriu dedičského práva, jeho zásadami, funkciami, predpokladmi a históriou. Ďalej dedičským konaním a úkonmi, ktoré vykonáva súd a notár ako súdny komisár v tomto konaní. Časti práce činnosť súdu a notár ako súdny komisár sú zamerané na ich pôsobnosť a úkony vykonávané pred začatím konania, v jeho priebehu, ale ja po ukončení dedičského konania. Cieľom je teoretické rozpracovanie dedičského práva a teoretická analýza činnosti súdu a notára ako súdneho komisára v konaní o dedičstve. Tieto ciele dosahujeme prostredníctvom deskripčnej metódy s použitím komparatívnych prvkov, za použitia dostupných zdrojov. Výsledkom je ucelený kontext teórie dedenia a činností pri ňom vykonávaných.
