Public authorities from the point of view of criminal law

Abstract:

Cílem této bakalářské práce je analyzovat základní pojmy související s výkonem veřejné správy (zejména pojmy orgán veřejné moci, úřední osoba a veřejný činitel) z pohledu trestního práva. V první části práce je provedena deskripce těchto pojmů, dále vyjmenování a popis trestných činů s nimi souvisejících. Jedná se o trestné činy ze strany veřejné správy a o trestné činy proti orgánům veřejné správy. Posléze je v druhé části práce analyzována judikatura Nejvyššího soudu související s definicemi těchto pojmů pro účely trestního práva.

Abstract:

The aim of this bachelor's thesis is to analyse basic concepts related to the performance of public administration (especially a public authority, a government official and a public official) from the perspective of criminal law. In the first part of the thesis, a descriptor of these concepts is carried out, as well as an enumeration and description of offences related to them. These are offences by the public authorities and offences against public authorities. the second part is made up of analysis of the supreme court judicature related to the definitions of these terms for the purposes of criminal lawin in this bachelor's thesis.
