The funds of qualified investors in the Czech Republic

Abstract:

Bakalářská práce se zabývá problematikou fondů kvalifikovaných investorů v České republice. Práce je formálně rozdělená na čtyři části. První se zabývá stručnou historií a vývojem fondů kvalifikovaných investorů v České republice. Druhá část se zabývá výkladem právní problematiky v oblasti fondů kvalifikovaných investorů, v této části jsou vysvětleny pojmy jako např. kvalifikovaný investor, obhospodařovatel, depozitář, právní formy fondů kvalifikovaných investorů apod. Ve třetí části jsou fondy děleny a srovnávány podle různých hledisek a kritérií. Čtvrtá část obsahuje konkrétní otázky ohledně fondů kvalifikovaných investorů, které vzešly z praxe. Rozhodování investorů do fondů je v současné době ovlivněno nejen právní a daňovou úpravou, ale do procesu rozhodování vstupují i psychologické a behaviorální či jiné aspekty, které mohou mít významný vliv na posuzování investic individuálními investory. Práce by měla celkově zhodnotit, jakou má zakládání a existence fondů kvalifikovaných investorů v našem tržním prostředí perspektivu, především v kontextu využití jako investičních nástrojů kolektivního investování, respektive nástrojů pro daňovou optimalizaci. Tato práce rovněž poukazuje na nesrovnalosti, které vznikají v praxi.

Abstract:

This thesis deals with the issue of qualified investors in the Czech Republic. The work is formally divided into four sections. The first part covers a brief history and evolution of these funds in the Czech Republic. The second part deals with the interpretation of legal issues in the field of qualified investors, this section explains terms such as qualified investor, the management company, the depositary, the legal status of qualified investor funds, etc. In the third part the funds are divided and compared by different perspectives and criteria. The fourth part contains specific questions regarding qualified investor funds resulting out of practice. The decision-making process of the investors in the funds is currently affected not only by the legal and tax regime, but it is also influenced by psychological, behavioural and other aspects which can have a significant impact on the assessment of investments by the individual investors. This work should generally evaluate the development and operation of funds of qualified investors in our market environment and its perspectives, especially in the context of their utilization as instruments for collective investing or/and vehicles for tax optimization. The work also highlights the discrepancies that arise in practice.
