Interrogation as a forensic method in a procedural act in an investigation

Abstract:

Diplomová práce se zabývá výslechem, který je považován za jednu z nejstarších kriminalistických metod. Teoretická část práce je rozdělena do několika bodů, ve kterých je uvedena podstata a cíl výslechu, legislativní vymezení. V práci je též rozebrána příprava na výslech a konstrukce samotného výslechu, včetně jeho dokumentace. Praktická část plynule navazuje na teoretickou část práce. Praktická část se skládá z rešerše judikatury, která se zabývá problematikou sugestivních a kapciózních otázek a dále z rozhovorů s vyšetřovateli.

Abstract:

The thesis focuses on interrogation, which is considered to be one of the oldest criminalistic methods. The theoretical part of the thesis is divided into several chapters in which the nature and purpose of interrogation, the legislative definition. The preparation for the interrogation and the construction of the interrogation itself, including the documentation of the interrogation, is also discussed. The practical part of the thesis follows up on the theoretical part of the thesis. The practical part consists of a search of case law dealing with the issue of suggestive and capricious questions and interviews with interrogators.
