Sumava National Park from the Legal Point of View - Development, Current Status and Perspectives

Abstract:

Předmětem této kvalifikační práce je Národní park Šumava. Jedná se o největší národní park v ČR, na jehož území se nachází velmi vzácné především lesní ekosystémy a který spolu s NP Bavorský les tvoří tzv. zelenou střechu Evropy. Aby mohlo být pojednáno o právní úpravě NP Šumava, bylo nutné shrnout nejdůležitější poznatky moderního vědního oboru - biologie ochrany přírody a mj. také lesnictví. Téma je velmi rozsáhlé, proto byly analyzovány pouze vybrané, v současné době kontroverzní oblasti, a to zonace národního parku, management lesních ekosystémů se zřetelem na bezzásahová území a asanační zásahy, ale také turistika. Jelikož NP Šumava a NP Bavorský les jsou považovány za jednotný celek, byly uvedené oblasti právní úpravy analyzovány i ve vztahu k tomuto německému národnímu parku. Právní předpis, jímž byl vyhlášen NP Šumava, je nařízení č. 163/1991 Sb., kterým se zřizuje NP Šumava a stanoví podmínky jeho ochrany. Byl přijat před účinností zák. č. 114/1992 Sb., o ochraně přírody a krajiny, ve znění pozdějších předpisů, a tudíž neodpovídá jeho požadavku na formu právního předpisu, jímž se národní parky vyhlašují. Proto se již dlouho usiluje o přijetí zákona o NP Šumava, jenž by tomuto požadavku vyhovoval. Projednávání posledních návrhů, podaných jednak zastupitelstvy Plzeňského a Jihočeského kraje a jednak Ministerstvem životního prostředí, bylo ukončeno jako důsledek rozpuštění Poslanecké sněmovny ČR v minulém roce. Tyto návrhy byly také podrobeny analýze. Výsledkem učiněných rozborů je návrh zákona, jenž by odpovídal zejm. výše naznačeným odborným požadavkům na právní úpravu NP Šumava, a poskytoval tedy efektivní ochranu tomuto jedinečnému území.

Abstract:

The thesis deals with the topic of Šumava National Park. It is the largest national park in the Czech Republic with very rare ecosystems, in particular forest ecosystems. The Šumava NP forms together with the Bavarian Forest NP “the Green Roof of Europe”. When dealing with legislation of the national park, it was necessary to sum up the most significant findings of the modern science known as conservation biology and of forestry as well. The topic is quite extensive, which is why the thesis focuses only on the analysis of selected, currently controversial areas, namely the zoning of the national park, management of forest ecosystems with regard to non-intervention areas, rehabilitation interventions and tourism. As the Šumava NP and the Bavarian Forest NP are considered one whole park, the stated parts of the legislation were analyzed in relation to the German national park. The founding regulation establishing the Šumava National Park is the regulation No. 163/1991 Coll.,that establishes the national park and defines the conditions of its conservation. The regulation passed before Act No. 114/1992 Coll., on Conservation of Nature and Landscape, as amended, came into force and thus, it is not in accordance with the legislative form for establishing national parks. For that reason, there have been long-term efforts to pass an act on the Šumava National park which would meet the requirement. The discussions about recent drafts of bills proposed by Plzeň region and South Bohemia region local authorities and the Ministry of Environment ended last year as a consequence of the dissolution of the Chamber of Deputies of the Czech Republic. These drafts were also analyzed in the thesis. The analysis results in a draft bill which would be in accordance with the above mentioned special requirements for the Šumava NP legislation and provide effective protection to this unique area.
