Criminal Law Protection of Children

Abstract:

Tato diplomová práce se zabývá trestněprávní ochranou dětí. Téma je velice obsáhlé, proto se středem zájmu stala problematika komerčního sexuálního zneužívání dětí. První dvě kapitoly pojednávají o postavení dítěte ve společnosti´a jeho vývoji a výkladu pojmu „dítě“. Následuje problematika dítěte jako obětí trestného činu. V poslední kapitole je řešena problematika komerčního sexuálního zneužívání dětí, které obsahuje tři základní formy obchod s dětmi, pornografii a prostituci. Práce je zaměřena na výklad těchto pojmů, analýzu a rozbor jednotlivých trestných činů dle zákona č. 40/2009 Sb., trestní zákoník, ve znění pozdějších předpisů. Některé trestné činy dle TZk jsou podrobeny srovnání se zákonem č.140/1961., trestní zákon, ve znění pozdějších předpisů. Zajímavostmi, jež doplňují hlavní téma jsou statistiky trestných činů a výsledky dotazníkového šetření.

Abstract:

This thesis deals with criminal protection of children. Because of the broad scope of these matters, the author of the thesis focuses only on the problems of commercial sexual exploitation of children. The first two chapters are concerned with the situation of children in the society and its development over time, and with defining of the concept of “a child”. Children as victims of criminal acts then follows. Commercial Sexual Exploitation of Children and its subsequent criminal acts (children trafficking, pornography and prostitution) are discussed in the last chapter. The thesis focuses on defining and analyzing of these concepts and criminal acts according to criminal laws as amended by Act no. 40/2009 of Penal Code. Some of the criminal acts are then discussed in the light of criminal laws as amended by Act no. 140/1961 of Penal Code. Some statistics and also a public survey are parts of this thesis as well.
