Execution of Pecuniary Penalty

Abstract:

Cílem této práce je zmapovat současnou právní úpravu ukládání a výkonu peněžitého trestu s poukazem na jeho aktuální využití v praxi jako alternativy k trestu odnětí svobody. V práci je shrnuta jak současná hmotněprávní úprava a procesněprávní úprava peněžitého trestu, tak provedena analýza ukládání a výkonu peněžitého trestu jednotlivými soudy. Výsledkem je rozbor důvodů nízkého využití peněžitého trestu soudy. Přínosem této práce je návrh řešení identifikovaných problematických aspektů právní úpravy.

Abstract:

The aim of this work is to map the current legal regulation of depositing and enforcement of a pecuniary penalty with reference to its current use in practice as an alternative to imprisonment. The thesis summarizes both the current substantive regulation and the procedural regulation of the pecuniary penalty, as well as the analysis of the imposition and enforcement of the pecuniary penalty by the individual courts. The result is an analysis of the reasons for the low use of the pecuniary penalty by the courts. The contribution of this work is a proposal of solution of identified problematic aspects of the legislation.
