Whistleblowing and protection of whistleblowers in Visegrad countries

Abstract:

Diplomová práce se zabývá tématem whistleblowingu a transpozicí směrnice EU o ochraně oznamovatelů. Cílem práce je zhodnotit úspěšnost implementace směrnice EU o whistleblowingu v jednotlivých státech Visegrádské čtyřky a na základě tohoto definovat návrhy a doporučení pro země V4, které povedou ke zlepšení implementace směrnice Evropské unie o whistleblowingu. V první části práce je vymezen samotný pojem whistleblowing a ochrana oznamovatelů, obecné povědomí o whistleblowingu v ČR a souvislost s korupcí. Druhá kapitola se zabývá ochranou oznamovatelů dle směrnice EU a vysvětluje, jaké důvody vedly k vytvoření této právní úpravy, také zmiňuje věcnou působnost směrnice a oblasti, do kterých zasahuje, jako např. zadávání veřejných zakázek, finanční služby. Třetí část práce se zaměřuje na problematiku implementace směrnice EU v jednotlivých členských zemích Visegradské čtyřky, tj. v České republice, Polsku, Maďarsku a na Slovensku. V závěrečné části jsou shrnuty poznatky vyplývající z komparace a na základě komparace zpracovány návrhy a doporučení, které povedou ke zlepšení implementace směrnice Evropské unie o whistleblowingu.

Abstract:

The diploma thesis deals with the topic of whistleblowing and the transposition of the EU directive on the protection of whistleblowers. The aim of the thesis is to evaluate the success of the implementation of the EU directive on whistleblowing in the individual countries of the Visegrad Four and to suggest proposals and recommendations for the V4 countries that can contribute to the improvement of the implementation of the directive. The first part of the thesis contains definition of whistleblowing and the protection of whistleblowers, general awareness of whistleblowing and its connections with corruption. The second chapter deals with the protection of whistleblowers according to the EU directive and explains the reasons for the creation of this legislation, the scope of the directive and the areas it affects, such as public procurement and financial services. The third part of the thesis focuses on the issue of the implementation of the EU directive in the individual member countries of the Visegrad Group, i.e. in the Czech Republic, Poland, Hungary and Slovakia. As a conclusion, the knowledge resulting from the comparison is summarized and contains specific proposals and recommendations, which will lead to the improvement of the implementation of the European Union directive on whistleblowing.
