Předkládaná práce se zabývá zvláštními způsoby dokazování v trestním řízení, které jsou uvedeny v ustanovení §104a až §104e zákona č. 141/1967 Sb., o trestním řízením soudním. Cílem práce je tyto procesní úkony jednotlivě popsat, a to z kriminalistického i trestněprávního hlediska a zaměřit se na vady, rizika či procesní zpochybnění, které mohou nastat při provádění rekognice. Abstract:
The presented work deals with special methods of evidence in criminal proceedings, which are listed in §104a to §104e of Act No. 141/1967 Coll., on criminal court proceedings. The aim of the thesis is to describe these procedural actions individually, from a criminological and criminal law point of view, and to focus on defects, risks or procedural challenges that may arise during identification.
