Selected Substantial and Procedural Aspects of Investors’ Misconduct in International Investment Law

Abstract:

Předmětem této práce je protiprávní jednání investorů, kterého se tito dopouštějí v průběhu života investic na území hostitelských států. Autorka v první řadě analyzuje vybrané aspekty hmotněprávní, zejména se zabývá pojmem “ilegality” coby konceptu práva národního a mezinárodního; popisuje, jaké typy jednání contra legem jsou způsobilé vyvolat mezinárodněprávní důsledky, a to v souvislosti s požadavkem určité intenzity nedovoleného chování. V druhé části se autorka zaměřuje na dopad takového jednání na proces mezinárodní investiční arbitráže. Zkoumá současné přístupy mezinárodních rozhodčích tribunálů, kriticky je hodnotí a prostřednictvím této práce předkládá návrh, dle jejího uvážení vhodnějšího způsobu reflexe ilegality na proces rozhodčího řízení. Jinými slovy odpovídá na otázku, v které části řízení by se mělo nelegální jednání samotné v rámci rozhodčího řízení zohlednit.

Abstract:

The thesis is focused on investors’ illegality made during the life of investments on the territory of host states. First of all, the author analyses selected substantial aspects, especially a notion of “illegality” as a national and international concept, the author then addresses the question of to which international law consequences can particular types of illegality lead to,which is closely connected to the issue of intensity of such illegality. In the second part of the thesis, the author points the attention to the impact of investors’ illegal conduct on arbitral proceedings. The author examines the jurisprudence of arbitral tribunals, critically assess it, and by virtue of this diploma thesis, she submits a proposal of more suited way of illegality reflection within the arbitral proceedings. In other words, she answers the question at what particular point of the proceedings, the issue of illegality should be addressed.
