President of the Region

Abstract:

Cílem této rigorózní práce je podat komplexní právní výklad k postavení a činnosti hejtmana kraje jako významného představitele územní veřejné správy v České republice, poukázat na zcela konkrétní praktické problémy spojené s jeho činností dle platné právní úpravy a v té souvislosti také předložit některé náměty de lege ferenda. Ačkoliv se s označením „hejtman“ pro různé veřejné funkcionáře nesetkáváme v platné právní úpravě historicky poprvé, obsahem srovnatelnou funkci k nynější funkci hejtmana kraje v předchozích právních úpravách nenacházíme. Podstatná část mé rigorózní práce je věnována vymezení působnosti hejtmana kraje dle zákona o krajích, ale také dle dalších právních předpisů. Hejtman, který je v platné úpravě zakotven jako jediný monokratický orgán kraje, je na rozdíl od všech ostatních orgánů kraje koncipován jako individuální hlava kraje, která má důležité kompetence při zastupování kraje navenek a také řadu zásadních pravomocí ve vnitřních věcech kraje. Všechny ostatní orgány kraje (tj. zastupitelstvo kraje, rada kraje, krajský úřad a zvláštní orgány kraje) jsou tvořeny větší či menší skupinou osob a občané kraje často nejsou schopni za touto skupinou vidět její jednotlivé členy. Jednotlivé pravomoci hejtmana jsou však charakteru spíše organizačního a vidimačního a hejtman je převážně obsazován do role vykonavatele vůle rady kraje či zastupitelstva kraje bez možnosti samostatného věcného rozhodování. I přes absenci výraznějších rozhodovacích pravomocí se hejtmani za krátkou dobu existence této funkce etablovali jako vlivná skupina velmi výrazných osobností hájících zájmy regionů, a z těchto regionů také leckdy ovlivňujících politické dění na centrální úrovni.

Abstract:

The thesis called „The President of the Region“ deals with the position, sphere of activities and competencies of the President of the Region as an important body of regional government (or „Higher municipalities“) in the Czech Republic. The President represents the Region in its external relations. He may carry out actions that require approval of the Council and the Assembly only on the basis of their previous approval. He has to be a citizen of the Czech Republic and is elected by the Regional Assembly. He is responsible for holding his office to the Assembly. The powers of the President are defined by law no. 129/2000 Coll. on regions, as amended. In the part, which is the focal point of the thesis, I discuss the competencies of the President of the Region. The President of the Region disposes of many important organizational and procedural powers related to the organization of activities and sessions of the Regional Assembly and the Regional Council. His position among the bodies of higher municipalities is really specific and privileged but he has no absolute veto power as far as the resolutions of the Regional Assembly and the Regional Council are concerned. The President of the Region can make independent decisions only on the basis of law, but he is not a real decision-making body. He may take measures that require approval of the Council and the Assembly solely on the basis of their previous approval.
