Customs Enforcement of Intellectual Property Rights in the Framework of the Internal Market of the European union

Abstract:

Diplomová práce se zabývá problematikou vymáhání práv duševního vlastnictví celními orgány na vnitřním trhu Evropské unie s ohledem na novou právní úpravu. Práce obecně pojednává o právních prostředcích vymáhání práv duševního vlastnictví a jejich rozdělení na prostředky soukromoprávní a veřejnoprávní. Práce se zaměřuje na popis nového systému vymáhání práv duševního vlastnictví celními orgány na vnitřním trhu. V diplomové práci jsou identifikována problémová místa nové právní úpravy, dále je provedena komparace a zhodnocení původní s právní úpravou novou. Pozornost byla zaměřena rovněž na vybrané problémy v oblasti vymáhání práv duševního vlastnictví, se kterými se lze v aplikační praxi setkat. Závěr práce obsahuje úvahy de lege ferenda.

Abstract:

This thesis deal with problem of customs enforcement of intellectual property rights in the framework of the internal market of the Europen union with regard to new legislation. The thesis generally descibes about legal means of enforcement of intellectual property rights and its distribution the priváte law means and the public law means. The thesis is focused on the description of new system of customs enforcement of intellectual property rights in the framework of the internal market. In frame the thesis there are identified problem fields of the new legislation, furthermore there are performed comparison and assessment old and new legislation. The attention was mainly focused on selected problematic practical questions in field of enforcement of intellectual property rights, with which is possible to meet them.
