Recognition of a person: Procedural Significance, Tactics and Documentation

Abstract:

Tato bakalářská práce je zaměřena na jeden ze zvláštních způsobů dokazování, zvaný rekognice, resp. rekognice osob. Rekognici obecně upravuje TrŘ v ust. §104b. Práce v počátku pojednává o pojmu rekognice, objektech a subjektech rekognice a fázovosti této kriminalistické metody. Následuje rozdělení rekognice podle základních klasifikačních hledisek a v této souvislosti popsány vybrané zvláštní druhy rekognice. Dále práce pojednává o vztahu rekognice k některým dalším zvláštním způsobům dokazování, konkrétně ke kriminalistické konfrontaci, výslechu, kriminalistické rekonstrukci a prověrce výpovědi na místě. Následuje rozbor současné právní úpravy a procesní význam rekognice. Další částí práce je taktika provádění rekognice a forma dokumentace. Závěrem práce jsou podrobně popsány vybrané případy spáchaných trestných činů, kde byly využity rekognice, jejich analýza a rozbor jejich provedení u každého z uvedených případů.

Abstract:

The topic of my Bachelor thesis is focused on one of special methods of proving called recognition of people. Recogniton is regulated by Code Of Criminal Procedure §104b. The thesis begins with explanation of the recognition concept, objects and subjects of recognition and phases of this criminalistic method. It continues with sorting the recognition according to basic classification aspects and description of selected special kinds of recognition in this context. The thesis also studies the relation of recognition to next special methods of proving, more specifically to criminalistic confrontation, interrogation, crime scene recreation and check of testimony in sit. Then follows analysis of current legislation and processional significance of recognition. Further part concentrates on performing recognition tactics and documentation style. The final describes selected cases of committed criminal offences in details which included recognition, their analysis and process of all listed cases.
