Abstract:

Problematika Souhlasu zákonného zástupce s osvojením dítte je rozebrána jak z hlediska hmotn-právní, tak i procesn-právní úrovn, a to v kontextu historické, souasné i navrhované právní úpravy. Je zde uvedena i právní úpravu dané problematiky ve vybraných zahraniních právních ádech. V souvislosti s tímto tématem je zde zmínna i problematika tzv. pímých adopcí, tzv. anonymních a utajených porod a babybox.

Abstract:

This diploma work deals with Consent of statutory representative with the adoption. If parents are not able to take care of their children, to create them family backround, the state provides for children system of substitute care. Czech law of substitute care takes place in the Family Code. The most significant form of substitute care is adoption. Family Code determines some preconditions and conditions for adoption. One of the most important is consent of statutory representative who is not directly parent. The theme of this work is analyzed in accordance with historical, contemporary and future law. Here is described legal situation in Czech Republic and in some foreign countries. This work also deals with regulation of direct adoption, regulation of anonymous and secret childbirth and regulation of babybox.
