Abstract:

Tato diplomová práce se zabývá institutem doručování v občanském soudním řízení podle zák. č. 99/1963 Sb., Občanského soudního řádu (dále jen "o.s.ř."), a souvisejících právních, zákonných i podzákonných, předpisů. Doručování je jedním z významných nástrojů civilního procesu, je prostředkem komunikace soudu s účastníky řízení ve všech procesních stádiích a zajišťuje tedy kontinuální průběh soudního řízení. Práce má za cíl poskytnout čtenáři ucelený, byť ne komplexní, náhled na vývoj institutu doručování v průběhu času, upozornit na zásadní změny a zvraty v systému doručování a v jeho chápání zákonodárcem i právní, zejm. soudní, praxí. Práce se má rovněž blíže zaměřit na právní úpravu doručování podle v současné době platné právní úpravy, neboť tato je výsledkem revoluční novely o.s.ř., která zcela změnila tvář doručování, když do jeho podstaty byly zapojeny moderní technologie a zároveň byla odpovědnost za doručení ve velké rozsahu přenesena na účastníky řízení adresáty.

Abstract:

This thesis deals with the institute of delivery service in civil court proceedings under the Act. No. 99/1963 Coll., Code of Civil Procedure (hereinafter as "o.s.ř.") and related juristical, legal and sub-legal regulations. Delivery service is one of the most important tools of civil law procedure, it is a means of communication of the court with the parties in all stages of the process and thus ensures continuous course of justice. The work aims to provide the reader with a comprehensive, though not complex insight into the development of the Institute of delivery service over time, to highlight the major changes and upheavals in the delivery service system and in his understanding of legislators and law, particularly judicial practice. The thesis also has a closer focus on the rules governing the delivery service in accordance with currently applicable regulations, as this is the result of revolutionary amendment to the o.s.ř., which has completely changed the face of the delivery service, when the modern technology is more involved into its nature and also more responsibility for the delivery service has been largely passed on to the parties - the addressee.
