Judicial Solution of the Selected Conditions of the Power of Administrative Courts to Annul or Decrease a Penalty: Manifestly Unreasonable Penalty and Decreasing a Penalty “within Lawful Limits

Abstract:

Rigorózní práce se věnuje vybrané dvojici podmínek oprávnění správních soudů snížit, popřípadě upustit od trestu uloženého za správní delikt. V souhrnu judikatury je vysvětleno, co zahrnuje shledání uloženého trestu „zjevně nepřiměřeným“. Práce se v této souvislosti soustředí na skutečnosti, které mohou správní soudy při „testu přiměřenosti“ zohlednit. Druhé významné téma rigorózní práce představuje analýza limitů, které pro soudy vyplývají z podmínky realizace moderace „v mezích zákonem dovolených“.

Abstract:

The thesis focuses on two selected conditions of the power of administrative courts to waive or decrease a penalty which has been imposed on account of an administrative delict. The case-law of courts has been summarized to clarify what does it takes to evaluate penalty as “apparently unreasonably large”. The thesis introduces which facts can be taken into consideration by administrative courts when carrying out “the test of proportionateness“. The second main topic represents analysis of limits that bind courts in process of decreasing a penalty “within lawful limits”.
