Primacy of EU law in relation to national legal systems of member states

Abstract:

Tato práce se věnuje problematice přednosti práva EU ve vztahu k vnitrostátním právním řádům členských států. Cílem je zjistit, do jaké míry má právo EU přednost před vnitrostátním právem členských států, a to zejména před právem ústavním. Toho se snaží dosáhnout vymezením konceptu přednosti práva EU prostřednictvím analýzy judikatury Soudního dvora Evropské unie a ústavních soudů zabývající se touto problematikou, výjimky z této zásady a její dopady na vnitrostátní právní předpis neslučitelným s právem EU. Práce se nadále snaží zodpovědět, jakou roli hraje ochrana základních práv garantována ústavami členských států v jejich přístupu k zásadě přednosti pomocí analýzy právních předpisů a judikatury vybraných členských států.

Abstract:

This thesis is concerned with primacy of European law in relation to national law of EU member states. The goal is to investigate, to what extent does European law have primacy in relation to national law of member states, and in particular their constitutional law. This is achieved by specifying the concept of primacy of EU law by looking at the practice of the Court of justice the European union and constitutional courts of member states that deal with primacy of EU law. This work also aims to look at the impacts of a national act that is incompatible with EU law. Furthermore, it attempts to answer to what extent does the protection of basic rights guaranteed by constitutions of member states affects the principle of primacy by looking at the practice of the courts of EU member states.
