Governments without Trust and Government in Resilience in Central Europe

Abstract:

Téma vlády, která vládne v demisi nebo bez vyslovení důvěry národního parlamentu, je nyní v odborných kruzích více než populární. Pouze v poslední dekádě zažila Česká republika 3 vlády, které vládly v tomto režimu. Vzpomeňme na 4 měsíční období mezi dvěma vládami premiéra Topolánka, více než 6timěsíční vláda v demisi premiéra Rusnoka a nyní v současnosti vláda v demisi premiéra Babiše. Hlasování o důvěře dané vlády se řídí ústavním, případně nejvyšším zákonem dané země. Ve střední Evropě, kam bych v rámci své práce rád zařadil Polsko, ČR a Slovensko se hlasování o důvěře vládě řídí vždy ústavou dané země. Jde o klasický nástroj parlamentního režimu, který charakterizuje odpovědnost vlády vůči národnímu parlamentu. Parlamentarismus lze rozdělit na negativní a pozitivní. V pozitivním parlamentarismu funguje pravidlo presumpce nedůvěry, tedy že vláda musí hlasováním v parlamentu prokázat, že je podporována většinou poslanců. Hlasování o důvěře vládě může probíhat na základě principu získání absolutní většiny, nebo na principu prosté většiny přítomných poslanců. Tento způsob je nám dobře znám z ČR, ale také z Polska nebo Slovenska. Hlasování dále dělíme na obligatorní a na fakultativní hlasování. Obligatorní, tedy povinné hlasování, nastává při nástupu nové vlády k moci, kdy je vláda povinna požádat o vyslovení důvěry. Fakultativní hlasování je využíváno v případech, kdy vláda s již vyslovenou důvěrou požádá parlament o opětovné hlasování, například pokud chce posílit svoji legitimitu. Dále je třeba podotknout, že hlasování o důvěře nemusí probíhat pouze vůči celé vládě, ale může se vztahovat pouze na osobu premiéra/premiérky (SRN) nebo k vládnímu programu (Litva). Ve své bakalářské práci bych se v úvodní části rád věnoval typologii mechanizmů vyslovení důvěry jednotlivých vlád, vyhledal definice takových typologií v kontextu národních ústav. Také bych se chtěl věnovat popsaní pravomocí takovýchto vlád, omezení jejich délky v čase a ostatním obranným mechanizmům na úrovni jednotlivých zemí. V práci vyhledám a uvedu konkrétní případy takovýchto vlád, zasadím je do kontextu dané doby a dění, s popisem hlavních aktérů. Hlavním cílem práce pak bude komparace jednotlivých vyhledaných a výše popsaných případů ve světle jednotlivých národních ústav.

Abstract:

A government, which governs in demise or without the confidence of the parliament, is currently more than a popular topic in professional circles. The Czech Republic experienced three of these governments just in the last decade, such as the period between the two governments of Prime Minister Topolánek, the more than six-month government of Prime Minister Rusnok, and the current government of Prime Minister Babiš. The confidence motion is controlled either by the constitutional or the national law of the country. The confidence motion is always controlled by the constitution of the country in central Europe, to which I would like to subsume Poland, the Czech Republic and Slovakia for the purposes of this thesis. It serves as a typical instrument of the parliamentary regime, which characterises the liability of the government towards the parliament. Parliamentarism can be divided into negative and positive. In positive parliamentarism, the presumption of no confidence functions, meaning the government must prove by the vote to the parliament that it is supported by the majority of the deputies. The confidence vote can be held on the basis of the principle of absolute majority, or the principle of simple majority of present deputies. This method is well known to us not only from the Czech Republic, but also from Poland and Slovakia. The voting can then be divided into obligatory and facultative. Obligatory vote occurs when a new government comes to power, where the government is obliged to ask for confidence. Facultative vote is held in cases where the government with already established confidence asks the parliament for another vote, for instance when they want to strengthen their legitimacy. Furthermore, I need to point out a vote of confidence does not have to be held towards the whole government, but can also be applied only to the Prime Minister (Germany), or the governing programme (Latvia). In my bachelor thesis, I would like to talk about the typology of mechanisms of confidence motions and find the definitions of these typologies in the context of national constitutions. Moreover, I would like to describe the authorities of these governments, their limitations in time, and other defensive mechanisms on the level of individual countries. Additionally, I will name specific examples of such governments, put them into the context of the time and the course of events, and define the main actors. The main aim of my thesis is to compare the individual examples described above in the light of individual national constitutions.
