Abstract:

Ačkoliv institut dovolání, zavedený novelou zákona o trestním řízení soudním č. 265/2001 Sb., koncipován jako zcela nový mimořádný opravný prostředek, do té doby se v našem trestním řádu nevyskytující, nelze si už na první pohled nepovšimnout jistých podobností s úpravou stížnosti pro porušení zákona. Otázkou tak je, jestli zákonodárce spolu s právní praxí nevytvořil fakticky stav, kdy se v právní úpravě našeho trestního řádu nadbytečně vyskytují dva velmi podobné mimořádné opravné prostředky.

Abstract:

This diploma work is entitiled The criminal claim and complaint of break of the law in the decisions of the Supreme Court and the Consti-tutional Court. The criminal claim and complaint of break of the law are the extraordinary legal remedies, which can be used in case that final de-cision of the court is deficient. The institute of the criminal claim was estabilshed by the Act No. 256/2001 Coll., which came into force on 1 January, 2002. On the other side the complaint of break of the law is part of the criminal law in the Czech Republic for more than half of century. The problem of complaint of break of the law is that only person who is entitled to launch is The Ministr of Justice and he does not need to give reason for his decision.
