Judicature Diversion

Abstract:

Tato diplomová práce se zaměřuje na téma judikatorního odklonu, tedy změny právního názoru, a s tím spojené otázky faktorů, jež k těmto změnám vedou, rozpoznání od skutkové či právní distinkce, otázky oprávněných subjektů, kterými smí být odklon činěn, časových účinků těchto změn a problému, koho vlastně změna právního názoru zavazuje. Toto konkrétní téma je zasazeno do obecného kontextu postavení judikatury v systému common law, především však v systémech kontinentálních, a následné závaznosti této rozhodovací činnosti.

Abstract:

This diploma thesis deals with a topic of judicial diversion, in other words, with a change of legal opinion. Its focus is on the main factors leading to these changes and their distinguishing from law-fact distinction. Moreover, the thesis discusses the legal subjects who are entitled to grand such diversion, the subjects who are bound by the legal opinion change as well as the validity period of these changes. The topic of judicial diversion is put into a general context of judicial status within common law system, primarily in continental legal systems and consequent legally-binding decision-making process.
