Customs regulation in the EC law - transit regimes

Abstract:

Česká republika prošla v uplynulých letech velkými změnami. Po roce 1989 začala budovat tržní hospodářství a připravovala se na vstup do Evropské unie. Nutným předpokladem každé země, která žádá o přijetí do této organizace, je harmonizace národního práva s právem Evropských společenství, a to postupně, v předem dohodnutých etapách. Tento vývoj se samozřejmě dotkl i oblasti celnictví. Právní úprava prošla mnoha změnami a dnes je již plně kompatibilní v právem Evropských společenství. Tam, kde Evropská společenství ponechávají prostor členským státům, je možno ponechat si svou národní úpravu (např.právní úprava povinností celníků). V první a druhé kapitole mé práce jsem se pokusila tento vývoj nastínit a teoreticky strukturovat systém právních norem v oblasti celnictví. Česká republika je vzhledem ke své geografické poloze důležitou tranzitní zemí. Je zde přepravováno zboží, které je zbožím Společenství, ale samozřejmě i zboží z třetích zemí. Při přechodu zboží přes hranici celního území Společenství přidělují celní orgány předloženému zboží tzv.celně schválené určení, kterým může být např. (jako jednou z možností) – propuštění zboží do některého celního režimu. Stručná charakteristika celních režimů je uvedena i v mé práci. Jedním z těchto režimů je i režim tranzitu, který se dále dělí na vnější tranzit, vnitřní tranzit a společný tranzit. Vzhledem k tomu, že ne celá geografická Evropa tvoří celní unii (celní unii tvoří pouze státy Evropské unie a dále je třeba celní unií Švýcarsko - Lichtejštejnsko), celý tranzit je z právního hlediska komplikovanější. Situaci usnadnila např. Úmluva o společném tranzitním režimu mezi zeměmi ESVO a EU, která umožňuje mezi členskými státy sjednocený přístup. Charakteristikou, právní úpravou, specifiky postupu při vyřizování režimu tranzitu se zabývá kapitola pátá mé práce. Vzhledem k obsáhlosti právní úpravy je celá problematika uvedená v základních pojmech a vztazích. Možnost využívání elektronického podání umožnila nejenom snadnější vyřízení celého režimu, ale současně celním správám ve státech Evropské unie umožnila vzájemné propojení a komunikaci, a tím usnadnila kontrolu pohybu zboží a pátrání po něm. Celní úřad, jak je uveden v kapitole šesté, je pověřen řadou úkolů – od administrativy až po zahájení pátracího řízení po zmizelém zboží či řízení k vymožení celního dluhu. Celní správa je oblastí, která se stále rozvíjí, a která vzhledem k neustále probíhajícímu mezinárodnímu obchodu bude vždy pověřována důležitými činnostmi.

Abstract:

The Czech Republic has got through substantial changes within the last few years. After 1989 it started to build up a market economy system, and prepared for joining the European Union. A fundamental prerequisite for each country applying for membership in this organization is gradual harmonization of national legal system with the European Union law that has a few stages agreed in advance. The development also touched upon the customs area. The legal adjustment went through many changes, and today it is fully compatible with the European Union law. Where the European Union allows some space for the member states, they can retain their own national rules (e.g. the legal regime of customs officers’ duties). I tried to outline the development and to structure theoretically the system of legal modifications of the customs area in the first and second chapters of my work. Considering the geographical location of the Czech Republic, it is an important transit country. Here they transport the Community goods as well as goods from the third countries. When crossing the frontier of the Community customs territory, the customs authorities assign so called “assessment approved by customs” to the goods submitted which may be e.g. (as one of a few possibilities) – release of the goods to a customs regime. Brief characterization of the customs regimes is also given in my work. The transit regime is one of the regimes, and it is divided into external transit, internal transit and common transit. As not the whole geographical Europe represents a customs union (the customs union consists only of the European Union member states, then there is e.g. the customs union of Switzerland - Liechtenstein), from the legal point of view the whole transit is more complicated. It was facilitated thanks to e.g. Convention on Common Transit Regime among the ESVO and EU Countries that enables united approach among the member states. The fifth chapter of my work deals with characterization, legal adjustment, specificities of the transit regime process. Owing to extensiveness of the legal adjustment, all the problems are given in basic terms and relations. Possibility to use electronic submission enabled not only easier execution of the whole regime, but it also enabled the customs authorities of the European Union countries mutual connection and communication, which made control over goods movement and search for them easier. The customs office, as it is mentioned in the sixth chapter, was given a lot of tasks – beginning with administration and ending with commencement of the search procedure for the goods lost or the procedure consisting in enforcement of liability to customs duty. The customs administration is an area that develops continuously and that in view of continuous international trade will always be entrusted with important activities.
