Interest from the point of view of income tax

Abstract:

Tato práce se zabývá zdaněním úroků daní z příjmů, a to jak z pohledu zapůjčitele, tak z pohledu dlužníka. Tato diplomová práce analyzuje přístup ke zdanění úroků z pohledu domácí legislativy i současných impulzů k jejímu zpřísnění a unifikaci na mezinárodní úrovni. V analytické části práce je obsažena právní komparace současné legislativy se změnami, které přináší implementace Článku 4 směrnice ATAD. Součástí analytické části práce je také analýza potenciálních dopadů zavedení nového pravidla odčitatelnosti úroků dle Článku 4 směrnice ATAD včetně kvantifikace dopadu na jednotlivé tržní segmenty.

Abstract:

This thesis deals with taxation of interest income both from the lender's point of view and from the point of view of the borrower. This diploma thesis analyzes the approach to interest taxation from the point of view of domestic legislation and current impulses to its tightening and unification at international level. The analytical part of the thesis contains a legal comparison of the current legislation with the changes brought about by the implementation of Article 4 of the ATAD Directive. Part of the analytical part is also an analysis of the potential impacts of introducing a new rule of interest deductibility under Article 4 of the ATAD Directive, including the quantification of impact on individual market segments.
