Abstract:

Cílem mé bakalářské práce bylo detailně popsat a definovat problematiku podpory v nezaměstnanosti a při rekvalifikaci a dále tuto problematiku analyzovat a zhodnotit s případným vlastním návrhem na úpravu této oblasti. V úvodu své práce jsem se zabýval vymezením zásadních pojmů, které jsou v případě mého tématu problematiky podpory v nezaměstnanosti a při rekvalifikaci stěžejní. Ve druhé kapitole jsem popisoval subjekty a tzv. „aktéry“, vzájemných vztahů na poli podpory v nezaměstnanosti a při rekvalifikaci. Dále jsem pozornost zaměřil na historii právní regulace na úseku Zaměstnanosti a její vývoj od roku 1989 s uvedením právních předpisů a prováděcích právních předpisů, které tuto oblast upravovaly. V kapitole čtvrté jsem se věnoval aktuálním právním předpisům, které upravují institut podpory v nezaměstnanosti a při rekvalifikaci. V praktické části jsem se zaměřil na zhodnocení stávajícího systému právní úpravy problematiky podpory v nezaměstnanosti a při rekvalifikaci. Provedl jsem analýzy podpory v nezaměstnanosti a při rekvalifikaci. Pro dosažení cíle analyzovat, zhodnotit a navrhnout nová řešení týkající se mého vybraného tématu jsem použil metodu dotazníkové šetření, kdy jsem prostřednictvím mnou vytvořeného formuláře získal od respondentů (uchazečů o zaměstnání) relevantní informace a údaje potřebné pro dosažení cíle mé práce. Dále jsem při analýze dané problematiky vycházel z informací, které jsem získal na základě rozhovorů s pracovníky Úřadu práce a uchazeči o zaměstnání. Na praktických případech jsem se snažil poukázat na některé nedostatky, které spatřuji v aktuální platné legislativě upravující oblast podpory v nezaměstnanosti a dále jsem tyto nedostatky konkrétně specifikoval a uvedl. Na základě závěrů z provedené analýzy jsem též formuloval návrh na možné zlepšení v této oblasti tím způsobem, že jsem navrhl v konkrétních ustanoveních úpravu textace zásadního právního předpisu zákona č. 435/2004 Sb., o zaměstnanosti upravujícího problematiku podpory v nezaměstnanosti a při rekvalifikaci.

Abstract:

The objective of my bachelor´s thesis was the detailed description and definition of the problems of unemployment benefit and retraining and further to analyse and evaluate these issues with my own proposal to changes in this area. At the beginning of my thesis I applied the basic fundamental concepts that are crucial in the cases of problems of unemployment benefit and retraining. In the second chapter, I described the subjects and the so called “participants“ in mutual relations in the area of the problems of unemployment benefit and retraining. Subsequently, I focused on the history of the legislation of employment and its development from 1989 with the introduction of legislation and the legal executive regulations in this area. In the fourth chapter I dealt with the current legislation governing the institute of the unemployment benefits and the retraining. In the practical part of my thesis, I concentrated on evaluating the present system of legislation of the problems of unemployment benefit and retraining. I carried out the analysis of unemployment benefit and retraining. To achieve the objectives of analysing, evaluating and proposing a solution concerning my topic, I used the method of questionnaires. I created my own form and obtained from respondents /job seekers/ the relevant information and data that I needed for the completion of my task. Further, for the analysis of these issues, I used the information that I obtained from interviews with employees at the Labour office and job seekers. In practical cases I made an effort to point out some shortcomings that I see in current legislation governing the area of the unemployment benefit and then I factually introduced and specified these shortcomings. Based on the conclusions of the analysis I formulated a proposal of possible improvements in this area by the suggestion of the correcting specific points in the texts in the fundamental legal regulation of the Act No.435/2004 Coll., on Employment concerning the issues of the unemployment benefit and retraining.
