Abstract:

Diplomová práce pojednává o inovativní konstrukci deliktních klauzulí náhrady škody ve světle změn nového občanského zákoníku. Práce se nejprve stručně a výstižně zaměřuje na samotný pojem čisté ekonomické újmy, jak je vymezován v tuzemské a zahraniční doktríně, a vysvětluje specifika této kategorie. Jádrem práce potom je strukturovaná analýza české právní úpravy a judikatury, a to i s výstižnou demonstrací na vhodně zvolených praktických modelových případech. Z práce plynou závěry využitelné v konkrétních situacích a jejím cílem je poskytnout co nejkonkrétnější pohled na to, za jakých podmínek lze čistou majetkovou újmu hradit, a za jakých již ne.

Abstract:

The thesis deals with innovative construction of tort damages clausules in the light of the changes that came with new civil code. At first, thesis concisesly and accurately focus on the term pure economic loss itself, as it is defined in national and also foreign doctrine and explain specifics of this category. The core of the work is structured analysis of Czech legislation and case law, even with a demonstration on a suitable practical model cases. The work results in conclusions useful in specific situations. The aim of the work is to then decipher as concretely as possible, the conditions under which the pure economic loss will be paid, and under which will not be.
