Reconstruction of Violent Criminal Acts

Abstract:

Tato diplomová práce se zabývá institutem rekonstrukce násilných trestných činů. Cílem práce je rozbor této kriminalisticko-taktické metody jak z hlediska trestněprávního, tak z hlediska kriminalistického. Práce je rozdělena na část teoretickou, která začíná úvodem, popisujíc čím se práce zabývá a jakých cílů by mělo být dosaženo. V první části teoretické části je práce zaměřena na historii kriminalistiky a historický vývoj rekonstrukce trestného činu v ČR, s tím je spojena současná právní úprava a zakotvení v trestním řádu tohoto institutu. Dále jsou vyjmenovány a popsány jednotlivé druhy kriminalistické rekonstrukce z hlediska kriminalistického. Práce se také věnuje deskripci subjektů účastnících se rekonstrukce trestného činu, poté jsou vylíčeny základní a taktické postupy a zásady rekonstrukce včetně celého průběhu a stádií. V neposlední řadě se práce zabývá dokumentací a hodnocení výsledků rekonstrukce. Kazuistická část popisuje prokazatelnou použitelnost této kriminalisticko-taktické metody v praxi.

Abstract:

This thesis aspires to analyze the investigative - tactical method of reconstruction of violent criminal acts from both, the criminal law standpoint and the investigative standpoint. This study is divided into a theoretical part, starting with the introduction, in which the author describes the topics covered and the goals of this study. The first section of the theoretical part focuses on the history of criminal investigation and the historical development of the criminal act reconstruction in the Czech Republic as well as the current legal adjustment and its anchoring in the legal code. Next, this study lists and describes different types of criminal act reconstructions from the standpoint of criminal investigation. This study also focuses on description of individual subjects attending the criminal act reconstruction, on basic and tactical procedures and on the principles of the overall reconstruction as well as of the different stages. Last but not least, this study analyses the documentation materials and evaluation of the reconstruction results. The case interpretation part describes a demonstrable usability of this investigative - tactical method in practice.
