Parental responsibility in the conception of the new Civil Code

Abstract:

Předkládaná diplomová práce podává ucelený pohled na současnou právní úpravu institutu rodičovské odpovědnosti. Toto téma je vzhledem k rekodifikaci soukromého práva v České republice velice aktuální. Diplomová práce se zaměřuje na tento institut právě ve světle občanského zákoníku (z. č. 89/2012 Sb.) a odpovídá na otázky typu, jaké jsou důvody terminologické proměnlivosti tohoto institutu, jaké obsahové změny nová kodifikace přinesla, včetně vlivů nadnárodních, a zdali jde o změny zásadní a pozitivní. V práci se věnuji právnímu postavení dítěte v českém právním řádu a povinnostem a právům rodičů. Stěžejní částí diplomové práce je detailní analýza institutu rodičovské odpovědnosti, kde se hlouběji zabývám pravidly ovládající výkon rodičovské odpovědnosti a jejím obsahem. Závěrem se věnuji zajímavé, avšak mimořádně citlivé problematice, a to zásahům do výkonu rodičovské odpovědnosti. Hlavním cílem této práce je tedy poskytnout pohled na institut rodičovské odpovědnosti tak, jak je upraven v občanském zákoníku a kriticky zanalyzovat předešlou a současnou právní úpravu dané problematiky.

Abstract:

The present thesis gives a comprehensive view of the current legislation of the institute of parental responsibility. Due to the recodification of private law in the Czech Republic this topic is very current. This diploma thesis focuses on this institute in the light of the Civil Code and answers questions such as what are the reasons for the variability in terminology of this institute, which content changes the new codification has brought including the transnational effects, and if such changes are fundamental and positive. The thesis pays attention to the legal status of children in the Czech legal code and the rights and responsibilities of parents. The main part of the thesis is a detailed analysis of parental responsibility, which is deeply concerned with the rules controlling the exercise of parental responsibility and its content. Finally, the thesis deals with an interesting but extremely sensitive issue, which are the interferences to the exercise of parental responsibility. The main aim of this work is thus to provide insight on the institute of parental resposibility in the form in which it is regulated by the Civil Code and to critically analyze the antecedent and current legislation issues.
