Abstract:

Ústředním motivem práce je rozhodnutí MSD ve věci Avena. Toto rozhodnutí slouží jako interpretační nástroj pro institut konzulární notifikace. Institut konzulární notifikace je mezinárodněprávní instrument zakotvený v čl. 36 Vídeňské úmluvy o konzulárních stycích. Práce institut konzulární notifikace rozebírá ve světle jak rozhodnutí ve věci Avena, tak i jiných rozhodnutí. Dále bylo rozhodnutí ve věci Avena prubířským kamenem schopnosti USA dodržet své mezinárodní závazky. V událostech následujících po tomto rozhodnutí se odhalují limity a problémy federativního uspořádání USA.

Abstract:

Thesis concerns with the ICJ decision in the case concerning Avena. This decision may serve as an interpretative tool for the institut of consular notification. Consular notification is an international instrument arising from Art. 36 of Vienna Convention on Consular Relations. This thesis analyzes the institut of consular notification in the light of the decision in case concerning Avena as well as another decision. Moreover the decision in the case concerning Avena was the touchstone of the ability of USA to comply with international obligation. Limits and problems of federative system has been revealed during the events following the ICJ decision.
