Abstract:

Tato diplomová práce se bude zabývat problematikou pohledávek. Diplomová práce bude mít několik částí. Nejprve bude popsána teoretická problematika zabývající se pohledávkami od jejich vzniku až po jejich vymáhání. Pak bude popsána situace ve vybrané společnosti. Nakonec bude provedeno shrnutí celé diplomové práce. V teoretické části se budu zabývat pohledávkami (vznik, příslušenství, evidence, oceňování, účtování, opravné položky, odpis, zápočet a zánik). Dále zde bude popsáno řízení pohledávek (základní principy, informační zdroje, náklady na řízení, posouzení a řízení rizik, řízení pohledávek v malých a středních podnicích). Také zde bude popsáno zajištění pohledávek (záloha, smluvní pokuta, ručení, zástavní právo, notářský a exekutorský zápis, směnka, bankovní záruka, dokumentární inkaso a akreditiv, faktoring, forfaiting). Budou zde uvedeny způsoby vymáhání pohledávek (věřitelem, agenturami, postoupením, soudním vymáháním, exekucí, rozhodčím řízením, likvidací a konkursem). V praktické části bude charakterizována vybraná společnost, způsoby získávání informací o klientech, hospodaření společnosti, vznik pohledávek a postup jejich vymáhání. V závěru bude provedeno celkové shrnutí diplomové práce.

Abstract:

This thesis will deal with the issue of debt. The thesis will have some parts. First will be described the theoretical issues dealing with claims from their inception to their enforcement. Then the situation will be described in the selected company. Finally, a summary will be made throughout the thesis. In the theoretical part I will deal with claims (creation, accessories, accounting, valuation, accounting adjustments, depreciation, credit and decline). There will also be described receivables management (basic principles, resources, cost management, risk assessment and management, receivables management in small and medium enterprises). Also, there will be described securing receivables (deposit, penalty, liability, liens, notarial and executor records, bills of exchange, bank guarantee, documentary collection and letters of credit, factoring, forfaiting). There will be the ways in Recovery (creditor agencies, assignment, judicial enforcement, execution, arbitration, liquidation and bankruptcy). In the practical part will be characterized by the selected company, ways of obtaining information about the clients, the company, the emergence of claims and procedure enforcement. At the end will be made a summary of the whole thesis.
