Medical opinion and its impacts on the rights and obligations of subjects of employment relationships

Abstract:

Cílem této diplomové práce je poskytnout přehled o současné právní úpravě, která upravuje problematiku pracovnělékařských prohlídek, lékařských posudků, poskytování pracovnělékařských služeb, jakož i práv a povinností stran související s touto problematikou. V neposlední řadě je cílem této práce podat přehled možných důsledků ztráty zdravotní způsobilosti k práci. Diplomová práce je rozdělena do tří hlavních kapitol. První kapitola poskytuje přehled právní úpravy a dále se obsáhle zabývá posudkovou péčí, zejména pracovnělékařskými prohlídkami, a lékařskými posudky. Práce pojednává o druzích pracovnělékařských prohlídek a jejich hrazení. U lékařských posudků se práce věnuje jejich právní povaze, obsahu, náležitostem, ale také jejich závěrům a přezkumu. V další kapitole se práce zaměřuje na pracovnělékařské služby, zejména jejich druhy a způsoby poskytování. Tato kapitola také pojednává o právech a povinnostech subjektů pracovnělékařských služeb. Poslední kapitola práce se zabývá důsledky ztráty zdravotní způsobilosti zaměstnance k práci, právy a povinnostmi účastníků pracovněprávního vztahu a možnostmi řešení těchto situací.

Abstract:

This thesis aims to provide an overview of the current legislation that regulates the issue of occupational health examinations, medical opinions, provision of occupational health care services, as well as the rights and obligations of the parties related to this issue. Additionaly, the aim of this thesis is to give an overview of the possible consequences of the loss of medical capacity to work. The thesis is divided into three main chapters. The first chapter provides an overview of the legislation and then deals extensively with assessment care, in particular occupational health examinations, and medical opinions. The thesis discusses the types of occupational health examinations and their reimbursement. As regards medical opinions, the thesis deals with their legal nature, content, requirements, as well as their conclusions and review. In the next chapter, the thesis focuses on occupational health care services in particular. This chapter also deals with the rights and obligations of the subjects of occupational health care services. The last chapter of the thesis deals with the consequences of the loss of an employee's medical capacity to work, the rights and obligations of the parties to the employment relationship and the possibilities of dealing with such situations.
