Principle of Subsidiarity of Criminal

Abstract:

Diplomová práce se zabývá zásadou subsidiarity trestního postihu a s ní spojeným principem „ultima ratio“ ve světle právních předpisů a judikátů soudů České republiky. Hlavní důraz je kladen na určení a rozpoznání hranice trestného činu, tedy tzv. společenskou škodlivost, jejíž určení je v jistých případech velice obtížné. Z tohoto důvodu se diplomová práce věnuje jednotlivým, a lze říci běžným případům, které se vyskytují a se kterými pracují orgány činné v trestním řízení. Jsou zohledněna kritéria, která oddělují jednotlivé skutky jak od soukromoprávního odvětví, tak od správního práva, u jednotlivých případů skutkových podstat trestných činů. Dále diplomová práce poukazuje na možné problémy, které s užíváním zásady subsidiarity trestního postihu nastávají a snaží se nalézt řešení.

Abstract:

The diploma thesis deals with the principle of subsidiarity of criminal sanctions and with the ultima ratio principle connected with it in the light of legal regulations and judgments of the courts of the Czech Republic. The main emphasis is placed on identifying and recognizing the boundaries of crime, ie. social harmfulness whose determination is in some cases very difficult. For this reason, the thesis deals with the individual and can be said to be common cases that occur and work with law enforcement agencies. The criteria that separate the actions from the private sector and the administrative law are taken into account for individual cases of offenses. Furthermore, the thesis points to possible problems that arise with the use of the subsidiarity principle of criminal sanctions and try to find a solution.
