A comparison of marital and paternal power over woman in case of infidelity

Abstract:

Diplomová práce se zaměřuje na oblast římského starověkého práva zabývající se stíháním sexuálních trestných činů. Konkrétně je zkoumán zločin cizoložství (lat. adulterium) a postihy pro nevěrnou ženu s tímto zločinem spojené. Práce analyzuje jednotlivé zákony stíhající zločin adulteria v oblasti antického Říma. Zkoumány jsou postupně zákony pocházející z nejstarší doby královské až do doby vydání zákonu císaře Augusta, lex Iulia de adulteriis coercendis. Práce prostřednictvím této analýzy zjišťuje, jaké pravomoci měl v antickém Římě nad cizoložnou ženou otec a jaké manžel, a snaží se tak odpovědět na otázku, čí pravomoci byly v této záležitosti rozsáhlejší.

Abstract:

This diploma thesis is focused on sexual crimes and its criminal prosecution in a field of Roman ancient law. Author analyses laws, which prosecuted women in a case of adultery and examines punishments for the adulterous women. The analysis contains different laws from the earliest period of Rome to an introduction of lex Iulia de adulteriis coercendis by emperor Augustus. By way of analysing the laws the thesis describes father’s and husband’s power, which they had over the adulterous women. Author tries to answer the question, whether father or the husband was more powerful in the matter of punishing adulterous women.
