The Decision-making in the Field of Immigration Law

Abstract:

Diplomová práce se věnuje tématu rozhodování správních orgánů v oblasti cizineckého práva. Úvodní kapitola představí základní principy, které se uplatňují v rozhodovacích procesech podle zákona o pobytu cizinců na území České republiky. Stěžejní část analyzuje správní řízení na úseku trvalého pobytu s důrazem na postavení rozhodujících orgánů. Práce se dále zabývá utajovanými informacemi jako jedním z podkladů pro rozhodnutí a rolí BIS v řízení. Poslední kapitola pojednává o soudním přezkumu rozhodnutí o povolení k trvalému pobytu, přístupu k utajovaným informacím v soudním spise a vlivu judikatury Nejvyššího správního soudu na praxi správních orgánů.

Abstract:

The thesis deals with the topic of decision-making of administrative bodies in the field of immigration law. The introductory chapter presents basic principles that apply to decision-making processes in accordance with the Act on the Residence of Foreign Nationals in the Czech Republic. The main part of the thesis analyzes administrative procedures in the field of permanent residency with emphasis on the position of decision-making bodies. Furthermore, the thesis focuses on classified information as a basis for decision and the part of BIS in proceedings. The last chapter deals with judicial review of decisions on permanent residence permit, access to classified information in the court file and the impact of the case law of the Supreme Administrative Court on the practice of administrative authorities.
