Diversions in criminal procedure

Abstract:

Tato diplomová práce pojednává o problematice odklonů v trestním řízení jako alternativě ke standardnímu trestnímu řízení. Odklony v trestním řízení úzce souvisí s rozvojem nové myšlenky spravedlnosti restorativní justice, která hledí na trestný čin jako na konflikt primárně mezi pachatelem a poškozeným, než jako na konflikt pachatele a společnosti. Jedná se o obnovující spravedlnost, která se snaží o pochopení trestného činu v jeho komplexnosti, od příčiny až po důsledek. Takovéto nahlédnutí trestného činu se snaží zprostředkovat obviněnému, na kterého takový náhled silně preventivně působí. Restorativní justice staví do popředí obviněného a poškozeného jako dva protipóly trestné činnosti, snaží se o jejich usmíření a nápravu jejich vztahů. Na myšlence restorativní justice se vytváří nový systém trestního řízení, který se snaží trestní proces zjednodušit za součastného zachování jeho kvality a velice široce pojatého systému práv obviněného. Tento systém charakterizují odklony v trestním řízení, jejichž komplexní přehled nabízí tato diplomová práce. S odklony v trestním řízení úzce souvisí systém, který se vytváří právě k naplnění myšlenky restorativní justice a jenž má za cíl přenesení části trestního řízení mimo soud. Je jím systém procesu mediace jako prostředku k naplnění myšlenky restorativní justice. Tento systém nabízí odbornou pomoc osobám zasaženým trestným činem a pomáhá jim k zvládnutí náročné životní situace. Tento systém je založen na dobrovolné účasti stran, které jsou k němu různě motivovány, jedná se o systém, který je veden vysokoškolsky vzdělanými odborníky, a proto zaručuje dodržování všech práv účastníků, stejně jako soudní proces. Tato práce podává komplexní přehled o odklonech v trestním řízení za současného zdůraznění myšlenky restorativní justice a procesu mediace. Zároveň navrhuje i rozšíření těchto institutů de lege ferenda na těžší trestné činy. Diplomová práce je doplněna o empirickou část, která učiněné poznatky demonstruje v praxi okresního soudu v Karlových Varech.

Abstract:

The thesis deals with the issue of diversions in the Czech criminal procedure which is regarded as an alternative to the standardized criminal procedure. The diversions in the criminal procedure are closely related to the development of a new idea of justice restorative justice which primarily considers criminal offence to be a conflict between the offender and the victim rather than a conflict between the offender and the community. Restorative justice is perceived as a justice which aims at comprehending the complexity of a criminal offence, beginning with the cause and ending with the consequence. This perspective of the criminal offence is showed to the accused person to whom such a perspective might cause a deeply precautionary perception. Restorative justice prioritizes the accused person and the injured person and puts them into a position of two antipoles of the criminal offence in an effort to their reconciliation and redress their relation. The idea of restorative justice creates a new system of the criminal procedure which makes an attempt to become more simplified, but also preserving its quality and broadly composed system of rights of the accused person. This thesis provides a complete overview of the described system which is characterized by the diversions in criminal procedure. The diversions in the criminal procedure are closely connected to a system which is created to accomplish the ideas of restorative justice and which also aims at transferring part of the criminal procedure away from the courtrooms. This system is called process of mediation. The mediation process offers specialized assistance to those who were affected by criminal offence and assists them to cope with arduous life situations. The mediation is based on voluntary participation of the both parties which are differently motivated. The process of mediation is led by specialists with university degrees, and thus all the rights of participants are equally preserved just as in the criminal trial. The thesis presents a thorough analysis of different diversions in the criminal procedure, including the ideas of restorative justice and mediation process. The thesis proposes an extension of these institutes de lege ferenda on more serious offences as well. The thesis includes an empirical part that has a purpose to apply the demonstrated theoretical results into practice, particularly concerning the work of the district court in Karlovy Vary.
