Contributions to Public Health Care Coordinated with the European Union Law

Abstract:

In my diploma thesis I remind of the concept of coordination of social security, its basic principles and European law. Designation of the state of which social security legislation is applicable in respect of coordinating regulations is of very importance for the states which finance health care for the most part from charged and collected contributions to public health care security. The applicable law in the field of health care security determine the calculation base, rates, the maturity and the recovery procedure of contributions to public health care as well as persons who subject to public health insurance. Peace of persons who subject to coordinating regulations is very important too. I find out differences and common features of social security contributions and income taxes. I find differencies out by the use of my own analysis as well as of the analysis of the judgments of the Court of Justice of the European Union. In the next part I describe the cooperation of institutions of member states in international recovery of social security contributions and consequently I compare it with the European law of international recovery of taxes. In the end I focus on practical problems that refer to insufficient migrant students' knowledge of the law of the European Union social security law and national law too.

Abstract:

Vo svojej diplomovej práci pripomínam pojem koordinácie sociálneho zabezpečenia, jeho základné princípy a základnú únijnú právnu úpravu. Určenie štátu, ktorý je príslušný v oblasti sociálneho zabezpečenia podľa ustanovení koordinačných nariadení je dôležité najmä pre štáty, ktoré financujú zdravotníctvo predovšetkým z odvodov na verejné zdravotné zabezpečenie. Uplatniteľné právne predpisy v oblasti zdravotného zabezpečenia určujú vymeriavací základ, sadzby, splatnosť i postup vymáhania odvodov na verejné zdravotné zabezpečenie, ako aj osoby, ktoré sú účastné na verejnom zdravotnom poistení. Dôležitá je však aj právna istota osôb podliehajúcich koordinačným nariadeniam. Poukazujem na rozdiely a spoločné charakteristiky odvodov na sociálne zabezpečenie a daní z príjmu. Odlišnosti nachádzam vlastnou analýzou i za pomoci rozboru rozsudkov Súdneho dvora Európskej únie. V ďalšej časti popisujem spoluprácu inštitúcií členských štátov pri medzinárodnom vymáhaní odvodov na sociálne zabezpečenie a následne ju porovnávam s únijnou úpravou medzinárodného vymáhania daní. V závere poukazujem na praktické problémy súvisiace s nedostatočnou informovanosťou migrujúcich študentov.
