Meaning of conditional release from prison

Abstract:

Bakalářská práce se zabývá udělením institutu podmíněného propuštění odsouzeným osobám umístěním ve výkonu trestu odnětí svobody, a to včetně navazující platné právní úpravy z pohledu hmotného i procesního práva. V rámci této práce jsou prezentována a hodnocena další s věcí související témata trestního práva v rámci individuální a generální prevence, která byla zohledněna i ve výzkumném šetření, která je nedílnou součástí bakalářské práce. Cílem bakalářské práce je zjistit přínosy, klady či zápory udělení institutu podmíněného propuštění s ohledem na veřejný zájem a možnou eliminaci recidivního chování vězněných osob. Část bakalářské práce se zabývá ukládáním délek zkušebních dob a dohledů, přičemž navazující body práce jsou zaměřeny na trestní sankce, ukládání alternativních trestů, efektivitu trestních sankcí a recidivu trestné činnosti vězněných osob. V teoretické části práce jsou představeny programy penitenciární a postpenitenciární péče. Výzkumné šetření dotváří komplexní pohled na dotčená témata z pohledu praxe.

Abstract:

This bachelor thesis deals with the granting of the institution of conditional release to convicted persons by placing them in custody, including the related legislation from the perspective of substantive and procedural law. In the thesis, further related topics of criminal law within the framework of individual and general prevention are presented and evaluated, which were also taken into account in the research that is an integral part of the bachelor thesis. The aim of the bachelor's thesis is to determine the benefits, pros or cons of granting the institute of conditional release with regard to the public interest and the possible elimination of recidivism of prisoners. One part of the bachelor's thesis deals with the imposition of lengths of probation and supervision periods, while the follow-up points of the thesis focus on criminal sanctions, the imposition of alternative sentences, the effectiveness of criminal sanctions and the recidivism of prisoners. The theoretical part of the thesis introduces penitentiary and post-penitentiary treatment programs. The research completes a comprehensive view of the topics from the perspective of practice.
