Methodology of investigating organized crime

Abstract:

Tato práce pojednává o metodice vyšetřování organizovaného zločinu, jakožto nejvyšší formě organizované kriminality, která představuje pro společnost značná rizika, neboť zasahuje do politické, hospodářské a právní sféry fungování státu, dále ovlivňuje státní správu. Jedná se o fenomén, který se vyskytuje napříč celým světem. Práce se člení do sedmi kapitol. První kapitola je zaměřená na definici organizovaného zločinu. Druhá kapitola se zabývá vývojem organizovaného zločinu. Třetí kapitola pojednává o organizované zločinecké skupině a jejím znakům a typologii pachatele organizovaného zločinu. Dále jsou v této uvedeny rozdíly mezi organizovaným zločinem a dalšími formami trestné činnosti. Čtvrtá kapitola se zaměřuje na rozdíly mezi jednotlivými formami skupinové trestné činnosti. Pátá kapitola se věnuje formám organizovaného zločinu s využitím příkladů zločineckých skupin. Šestá kapitola se zabývá vyšetřováním organizovaného zločinu a metodikou vyšetřování organizovaného zločinu z kriminalistického pohledu. Popisuje zvláštnosti počátečních a následných úkonů, prostředky ve vyšetřování a dokazování organizovaného zločinu, jako jsou operativě pátrací prostředky, zajišťovací prostředky nebo podpůrné operativně pátrací prostředky. Dále jsou v ní uvedeny národní a mezinárodní instituce pro boj s organizovaným zločinem. V sedmé kapitole jsou uvedeny skutečné kauzy organizovaného zločinu z 20. století.

Abstract:

This work deals with the methodology of investigating organized crime, as the highest form of organized crime, which poses significant risks for society, as it interferes with the political, economic and legal spheres of state working, and further influences state administration. This phenomenon occurs all over the world. The work is divided into seven chapters. The first chapter focuses on the definition of organized crime. The second chapter deals with the development of organized crime. The third chapter deals with the organized crime group and its features as well as the organized crime perpetrator´s typology. This also shows the differences between organized crime and other forms of crime. The fourth chapter focuses on the differences amongst the various forms of group crime. The fifth chapter deals with forms of organized crime using examples of criminal groups. The sixth chapter deals with the investigation of organized crime and the methodology of investigating organized crime from a criminal point of view. It describes the curiosities of initial and subsequent actions, means in investigating and proving organized crime, such as operational search means, securing means or supporting operational search means. Furthermore, there are listed national and international institutions to fight against the organized crime. The seventh chapter presents the real cases of organized crime from the 20th century.
