U.S. Foreign Policy under George W. Bush Administration and Just War Theory

Abstract:

Koncept spravedlivé války představuje důležité vodítko pro morální hodnocení zahraničně-politického jednání států. Předložením normativních kritérií pro vstup do války, její vedení a ukončení se snaží omezit výskyt válek a limitovat jejich destruktivnost. V minulých desetiletích dochází v teorii spravedlivé války k revizi jejích základních principů, které se ve své tradiční interpretaci, vycházející z křesťanské etiky, zdají jako nedostatečné pro dnešní dobu, která zahrnuje nové druhy hrozeb národní bezpečnosti. Diplomová práce se snaží analyzovat moderní přístup ke konceptu spravedlivé války, a to zejména k její oblasti jus ad bellum. Ten se projevuje především rozšířením kritéria spravedlivého důvodu směrem k přijetí spravedlnosti preemptivní války reagující na vážné, přestože vzdálené hrozby, navrácením legitimní autority k vyhlášení války do rukou suverénních států či omezením striktního lpění na principu užití síly jako poslední možnosti. Nově je zdůrazňována také oblast spravedlivého ukončení válek jus post bellum založená buď na minimalistické vindikaci práv, nebo na maximalistické etice odpovědnosti. Současné sekulární i křesťanské interpretace spravedlivé války jsou využity ke studiu tří zásadních projevů americké zahraniční politiky za vlády prezidenta George W. Bushe – válek v Afghánistánu a Iráku a Národní bezpečnostní strategie. Je studován soulad a vzájemné ovlivňování moderních kritérií spravedlivé války s americkou bezpečnostní koncepcí a prokázána přítomnost morálního uvažování v zahraniční politice USA za Bushovy administrativy. V americké strategii vůči Afghánistánu a Iráku je odhalena přítomnost revidovaných kritérií spravedlivého důvodu, legitimní autority, poslední možnosti a maximalistického přístupu k jus post bellum.

Abstract:

The just war theory represents an important guidance for moral appraisal of foreign policies of states. It offers a set of normative criteria for state’s resort to war, its waging and termination. In this way the theory seeks to limit the occurrence of war and its destructiveness. In the last decades there appears to be a pressure for revision of some of the fundamental criteria of just war, because their traditional interpretation seems to be inadequate for dealing with modern forms of threats to national security of states. The master’s diploma thesis analyzes modern approaches to the concept of just war, mainly to the field of limits on the resort to war - jus ad bellum. The modern reinterpretation of jus war theory admits that preemptive war in response to grave, though remote threats can be justified, it gives legitimate authority for waging wars to the hands of sovereign states, and it also disapproves with strict reading of the just war criterion of last resort. New significance is ascribed to the justification of ends of wars – jus post bellum. Attitude to this field among modern contributors to the just war theory is either minimalist emphasizing vindication of rights or maximalist based on ethics of responsibility. Contemporary secular and Christian interpretations of just war are used in the thesis as analytical tools for the study of three main manifestations of the U.S. foreign policy under President George W. Bush – wars in Afghanistan and Iraq and the U.S. National Security Strategy. The object of the thesis is to disclose the presence of moral reasoning and elements of modern interpretations of the just war theory in the U.S. foreign policy under Bush administration. The U.S. strategy in Afghanistan and Iraq is found to be consistent with revised criteria of just cause, legitimate authority, last resort and maximalist jus post bellum.
