Supporting measures hampering the ability of an adult legally one ton

Abstract:

Bakalářská práce pojednává o podpůrných opatřeních při narušení zletilého právně jednat. Hlavním cílem této práce je seznámení čtenářů s možnostmi podpůrných opatření, snažím se i o nastínění, co k současným právním institutům vedlo. Cílem mé bakalářské práce je taktéž komparace zákona o zdravotních službách a dle zákona č. 89/2012 Sb., občanský zákoník, práva nezasahovat do integrity a práva převzetí do zdravotnického zařízení bez souhlasu. V poslední části práce se věnuji omezení svéprávnosti a kontrole opatrovníka, souhrnně popisuji práva zainteresovaných.

Abstract:

This bachelor thesis deals with support measures for adults with disrupted ability to undertake legal acts. The main goal of the thesis is to introduce readers to available support measures; the author also describes what led to the current legal support instruments. Another aim of the thesis is to compare the Act on Healthcare Services and the Law No. 89/2012 Coll., Civil Code, specifically their treatment of the right to not interfere in the integrity and the right to accept somebody to a health facility without consent. In the final part of the thesis, the author deals with legal capacity limitations and guardian control, comprehensively describing the rights of parties involved.
