Abstract:

Problematiku pozemkových úprav jsem po základních teoretických znalostech z dřívějšího studia poznal také ve světle paragrafů v platné právní úpravě. Předně musím konstatovat, že pozemkové úpravy jsou opatření konající se ve veřejném zájmu vlastníků pozemků v konkrétním vymezeném obvodu pozemkových úprav. Je mnoho oblastí, které se s pozemkovými úpravami pojí. Za nezbytné jsem považoval osvětlení vztahu k územnímu plánování, jakožto k druhému významnému nástroji utváření krajiny kolem nás. Tento vztah je upraven i v zákoně, když při zpracování návrhu pozemkových úprav je postupováno ve vzájemné interakci s návrhem veřejně prospěšných staveb a opatření z návrhu územního plánu a vůbec za jakéhosi dohledu orgánů územního plánování. V platné právní úpravě je institut pozemkových úprav poměrně přehledně popsán v zákoně č. 139/2002 Sb., o pozemkových úpravách a pozemkových úřadech a ve vyhlášce č. 545/2002 Sb., o postupu při provádění pozemkových úprav a náležitostech návrhu pozemkových úprav. Pohle mého názoru by se zákonodárci mohli zamyslet nad přehlednějším zapracováním řádných i mimořádných opravných prostředků k rozhodnutím o pozemkových úpravách i k možným občanskoprávním sporům. Z hlediska dotčeného vlastníka jsou pozemkové úpravy nástrojem respektujícím jeho vlastnické a jiné věcné právo k pozemkům vstupujícím do pozemkové úpravy. Dávají mu možnost se v průběhu řízení vyjádřit přes poradní orgán sboru zástupců nebo vznést námitku. Hlavní problém pozemkových úprav vidím v nedostatečné finanční podpoře, ať již ze státních, soukromých nebo unijních prostředků. Dotační program Evropské unie pro výstavbu společných zařízení skončí rokem 2013, v napjatém státním rozpočtu se čím dál méně objeví potřebná injekce pozemkovým úřadům a tak zbývá snad jen soukromá sféra soustřeďující se hlavně u pozemkových úprav zahajovaných v souvislosti s investiční výstavbou. Snad to nebude znamenat omezení výstavby společných zařízení zejména protierozních, vodohospodářských a zvyšujících ekologickou stabilitu území. Další problém vidím v nedostatečné informovanosti veřejnosti. Mnoho lidí z mého okolí pojem „pozemkové úpravy“ v životě neslyšelo, neví, jaké možnosti ve zvelebení krajiny a funkčního uspořádání pozemků tento nástroj skýtá. Funkce obnovení katastrálního operátu, zpracování nové katastrální mapy a zpřesnění hranic a evidence našich pozemků v katastru nemovitostí také není zanedbatelným faktorem na pomyslné misce vah. Až čas ukáže, jak se budou pozemkové úpravy dále vyvíjet. Po tzv. „sametové“ revoluci však změnou právních předpisů a čerpáním dotací z Evropské unie udělaly jasný krok správným směrem. Byla by škoda v tomto vývoji ustrnout, ba dokonce se vrátit zpět.

Abstract:

After acquiring the basic theoretical knowledge in my former studies, I have come to know the issue of land adjustments also in the light of laws in the valid legislation. Firstly, I have to observe that land adjustments are measures that are executed in the public interest of the land owners in the given delineated area of land adjustments. There are many spheres that are connected to land adjustments. I considered it inevitable to clarify its relation to land planning as the second significant instrument in the creation of the landscape around us. This relation is also addressed in the legislation, when the processing of a proposal for land adjustments proceeds in mutual interaction with a proposal for publicly beneficial buildings and measures from the land plan proposal, and on the whole it is under the supervision of the land planning bodies. In the valid legislation, the institute of land adjustments is comparatively clearly described in the Act No 139/2002 Collection of Laws on land adjustments and land administration and in the Regulation No 545/2002 Collection of Laws on the proceedings in land adjustment execution and proprieties of land adjustment proposal. According to my idea, the lawmakers could further elaborate on a clearer incorporation of ordinary and extraordinary legal remedies to decisions on land adjustments and also to possible civil court disputes. From the point of view of a given owner, land adjustment is an instrument that respects his/her ownership and other material rights to lands entering the land adjustment process. It gives him/her the right to express themselves during the course of administration via a consulting organ of the body of representatives, or to raise an objection. I see the main problem of land adjustments in an insufficient financial support, be it from the state, private or EU means. The donation program of the European Union for the construction of common facilities is to end by 2013, in the strained state budget the necessary financial injection for the land administration is to appear less and less, and so there remains perhaps only the private sector concentrating mainly around land adjustments initiated in connection with investment constructions. Let’s hope this will not mean restricted construction of common facilities, especially anti-erosive, water utilizing and those that increase the ecological stability of the given territories. I see another problem in the insufficient informing of the public. Many people from my surroundings have never in their lives heard the term “land adjustment”, they do not know what possibilities this instrument holds as to the reconditioning of the landscape and functional arrangement of lands. The function of innovation of the cadastre operative, incorporation of the new cadastre map, more specific borders and the evidence of our lands in the cadastre of real estates are also not a negligible factor on the imaginary balance pan. Only time will show how the land adjustments will further evolve. However, after 1989 they made a clear step in the right direction via the change of legal regulations and by drawing on the funds from the EU. It would be a pity to stagnate in this development, let alone going back.
