Trade Related Aspects of Patent Protection in Pharmaceuticals

Abstract:

Práce se věnuje obchodním aspektům patentové ochrany léčiv. První část shrnuje vývoj mezinárodní úpravy patentové ochrany a její dopady pro podnikání ve farmacii. Druhá část analyzuje konkrétní aspekty - dobu trvání patentové ochrany, paralelní importy a institut nucené licence. Popsány jsou dopady patentové ochrany na podnikání s generickými léčivy. Pozornost je věnována kopírování patentů. Třetí část práce porovnává postoje farmaceutického průmyslu a vlád, především rozvojových zemí. Sleduje aktuální vývoj problematiky v rámci Světové obchodní organizace.

Abstract:

The purpose of my thesis is to analyse the trade-related aspects of patent protection in pharmaceuticals. The first part focuses on the international regulation of patent protection and its impact on conducting business in the pharmaceutical industry. Chapter Two addresses the issue of relevant trade-related aspects - patent duration, parallel imports and compulsory licence. It describes the impact of patent protection on the generic pharmaceutical industry. Chapter Three concentrates on the attitudes of the pharmaceutical industry and governments, especially those of developing countries. It examines the progress within the World Trade Organization (WTO).
