Abstract:

Tato práce zkoumá vědeckou disciplínu jménem forenzní lingvistika a její využití pro dokazování autorství dokumentů v právním kontextu. Hlavním cílem této práce je ověřit hypotézu, že individuální styl psaného jazyka může být prozkoumán, zanalyzován a na základě této analýzy přiřazen k autorovi daného textu. Teoretická část této práce slouží jako úvod do oblasti forenzní lingvistiky, vnímání individuálního stylu psaného jazyka a nejrůznějších současných postojů k problematice dokazování autorství právních dokumentů. Tato část také naráží na teorii, že některé vlastnosti jazyka jsou více konzistentní a stabilní mezi texty od jednoho autora než ostatní, což představuje další hypotézu, na kterou se snaží odpovědět část praktická. Poznatky z teoretické části jsou využity k tvorbě vzorové metody pro dokazování autorství dokumentů a její následnou aplikaci na texty z reálného soudního procesu. Práce využívá tuto vzorovou analýzu k zodpovězení hypotéz o individuálním stylu psaného jazyka a robustnosti určitých jazykových vlastností, spolu se všemi klady i zápory současných postojů a metod, které se pro dokazování autorství dokumentů v právním kontextu v současné době používají.

Abstract:

The thesis discusses the scientific discipline of forensic linguistics and its use for authorship attribution of documents in legal setting. The main aim of the thesis is to elaborate on the hypothesis that individual style of writing can be observed and analyzed, and that the writing can be after such analysis attributed to its author. The theoretical part of this thesis serves as an introduction to the field of forensic linguistics, the perception of individual writing style and the current various approaches to forensic authorship attribution. This part also touches upon a notion that certain language features are more consistent and stable throughout texts from one author than others, which serves as another hypothesis the practical part of the thesis tries to answer. An example authorship attribution method is composed based on the findings from the theoretical part and used for an analysis of texts from a real criminal case. The hypotheses concerning the possible observation of individual writing style and the robustness of certain language features are further elaborated upon using the example analysis, along with all the benefits and drawbacks of the currently used forensic authorship attribution methods.
