Abstract:

Tématem mé diplomové práce je Cochemská praxe. Cílem teoretické části mé diplomové práce je analyzovat průběh Cochemské praxe. Hlavním cílem výzkumné části práce je pomocí komparativní analýzy porovnat aplikaci Cochemského modelu v zahraničních soudních řízeních. Dílčím cílem komparace je zhodnotit, jakým způsobem je Cochemská praxe realizována v českých legislativních podmínkách. V první kapitole se zabývám základními pojmy. Konkrétně se jedná o druhy péče, které jsou relevantní k tématu mé práce. Druhá kapitola se věnuje opatrovnickému řízení a úloze jednotlivých složek v opatrovnickém řízení. Třetí kapitolou je historie Cochemské praxe. Čtvrtá kapitola, jedna ze stěžejních, se věnuje Cochemské praxi v Německu, jejímu průběhu a úloze jednotlivých složek. Pátá kapitola, také stěžejní, se zaměřuje na Cochemskou praxi v České republice a zahraničí. Šestá kapitola se věnuje metodologii a analýze dat a sedmá kapitola je věnována diskusi.

Abstract:

The topic of my thesis is the Cochem practice. The goal of the theoretical part of my thesis is to analyse the Cochem practice's process. The goal of the research part is to compare how the Cochem practice is realised in legislative conditions abroad. A subsidiary goal of this comparison is to evaluate how the Cochem practice is realised in the legislative conditions of the Czech Republic. The first chapter is centred around basic terminology, which defines the kinds of custody that are relevant to my thesis' topic. The second chapter is devoted to the guardianship process and the roles of different parts of the process. The third chapter describes the history of the Cochem practice. The fourth chapter, one of the key ones, is centred around the Cochem practice in Germany, its process and the roles of the parts which compose it. The fifth chapter, also key, is focused on the Cochem practice in the Czech Republic and abroad. The sixth chapter deals with methodology and data analysis, and the seventh chapter is devoted to discussion.
