Protection of copyright and the music industry

Abstract:

Bakalářská práce „Ochrana autorských práv v hudebním průmyslu“ pojednává o funkci autorského práva, o jeho historickém vývoji a připomíná základní pojmy používané v autorském právu. Jsou zde uvedeny nejdůležitější mezinárodní úmluvy a právní předpisy ČR, které upravují autorské právo. Cílem práce je analyzovat současný stav v oblasti ochrany autorských práv s přihlédnutím k ekonomickým dopadům porušování těchto práv v hudebním průmyslu. Práce popisuje případy tzv. hudebního pirátství. Uvádí nejznámější spory mezi autory a uživateli ve světě posledních let. Také se zaměřuje na specifické problémy ochrany autorských práv v hudbě v ČR. Popisuje fungování organizací IFPI, OSA a Intergram. Poslední část práce se zabývá placením stahování hudby, aktivitami autorských organizací v rámci EU a iniciativou Sarkozyho na zpoplatnění internetu. Závěr práce tvoří shrnutí situace a učinění výhledu na další období.

Abstract:

Bachelor thesis "Protection of copyright in the music industry"deals with the copyright office, its historical development, and recalls the basic concepts used in copyright law. There are listed the most important international conventions and legislation CR governing copyright. The aim is to analyze the current state of copyright having regard to the economic impact of violations of these rights in the music industry. The paper describes the cases of so-called music piracy. Features the best known disputes between authors and users in the world in recent years. It also focuses on specific problems of protection of copyright in music in the country. Describes the organization of IFPI, OSA Intergram. The last part deals with the payment of downloading music copyright organizations in the activities of the EU, and Sarkozy's initiative on charging for the Internet. The thesis concludes with a summary of the situation and making the outlook for the next period.
