The Judicial Review of Public Administration, the Role of Administrative and Constitutional Judiciary in the System of Public Administration Controls

Abstract:

Bakalářská práce „Soudní kontrola veřejné správy, úloha správního a ústavního soudnictví v systému kontroly veřejné správy“ je zaměřena na nástin aktuálního stavu nezávislé kontroly veřejné správy v České republice. Nemůže být detailním popisem jednotlivých mechanismů; jde spíše o obecný pohled na všechny možnosti, které současná legislativa nabízí, a to i mimo rámec správního soudnictví. Cílem práce je zejména za využití judikatury správních soudů a Ústavního soudu poukázat na rozmanitost případů, které mohou být podrobeny nezávislé kontrole. Současně se práce pokouší o vlastní hodnocení popisovaných mechanismů, se zřetelem k praktickému dopadu výsledků rozhodovací činnosti těchto orgánů do veřejných subjektivních práv fyzických a právnických osob.

Abstract:

This bachelor thesis „Judicial control over public administration, the role of administrative and constitutional justice in a system of judicial control over public administration“ is focused on the outline of actual conditions of the independent control over public administration in Czech Republic. The thesis cannot have pretensions to a detailed description of particular mechanisms; it aims rather to give a general overview of all opportunities offered by the present legislation, including the opportunities beyond the scope of judicial review. With the help of real decisions issued by administrative courts and by The Constitutional Court of the Czech Republic, is the aim of this thesis (above all) to point to the various cases which can be brought under (judicial) control. At the same time, the thesis attempts to give its own assessment of described mechanisms, with accent to practical impact of judicial decision-making into public subjective rights of (both) natural and legal persons.
