Abstract:

Každý vyspělý právní systém musí disponovat kontrolními mechanismy pro ověřování procesní a materiální legality opatření, přijímaných jeho institucemi. Jinak tomu není ani v rámci Evropské Unie, kde existence takového systému má zásadní význam zejména s ohledem na objem sekundárního práva produkovaného orgány EU a na ne zcela vyvinuté politické kontroly aktivit EU občany členských států. V Evropské Unii spočívá toto břemeno na Evropském soudním dvoru (dále jen Soudní dvůr), Soudu prvního stupně a nově také na Soudu pro veřejnou službu Evropské unie, jež jsou nezávislými orgány, kterým byl Smlouvami svěřen úkol, dohlížet nad dodržováním práva v Unii. Žaloba na neplatnost podle čl. 230(4) SES, která je předmětem této práce, zaujímá v tomto systému ústřední pozici. Čtvrtý pododstavec čl. 230 SES umožňuje neprivilegovaným navrhovatelům (každé fyzické a právnické osobě) přímo napadnout domněle protiprávní komunitární akt. Tato možnost se odvíjí od přímého účinku, který komunitární právo má nejen vůči členským státům, ale v některých případech i vůči právnickým a fyzickým osobám. Jak vyplývá z názvu a z textu, locus standi neprivilegovaných žalobců podle článku 230(4) SES je hlavním předmětem této diplomové práce, jejíž celý název zní: “Žaloba podle čl. 230 odst. 4 Smlouvy o založení ES - locus standi pro “neprivilegované“ žalobce“. Způsobilost podat žalobu (nebo-li locus standi) za účelem napadení platnosti sekundárního komunitárního práva, udělená tímto článkem jednotlivcům, byla a je předmětem mnoha akademických studií, z nichž většina je kritická vůči přístupu Soudního dvora k této problematice, neboť jej považuje za příliš restriktivní. Přestože se tato kritika ozývá již po mnoho let, Soudní dvůr se jí zdá být nijak nerozrušován. Kritika především poukazuje na to, že možnosti dané jednotlivcům podle čl. 230(4) SES jsou ve skutečnosti velmi limitovány požadavky zahrnujícími locus standi podmínky (tj. podmínky přímého a individuálního dotčení). Tato omezení zakotvená Smlouvou spolu s jejich přísnou interpretací Soudním dvorem, pak představují závažnou překážku, pokud jde o přístup fyzických a právnických osob k soudům EU. Hlavním cílem této práce je poskytnout čtenáři celkový přehled o tomto tématu a pomoci mu pochopit podmínky, které by jako fyzická či právnická osoba musel splnit, pokud by zamýšlel napadnout sekundární komunitární akt. Tyto podmínky detailně zanalyzuje, přičemž důraz bude kladem především na judikaturu Soudního dvora a Soudu prvního stupně a její vývoj či nevývoj v průběhu let až do současnosti.

Abstract:

Every developed legal system must have a mechanism for testing the procedural and substantive legality of measures adopted by its institutions. In the European Community it was of a significant importance to create a system of control over the acts of the Community Institutions given the democratic deficit within the Community and limited supervisory role of the European Parliament. The main burden rests on the European Court of Justice, the Court of First Instance and, newly, on the European Union Civil Service Tribunal, which are the independent bodies entrusted by the Treaties with the task of upholding the rule of law in the Community. The action for annulment, regulated by Article 230 EC, occupies the central position within this system. Paragraph four of Article 230 allows the non-privileged applicant (every natural or legal person) to challenge directly the allegedly illegal Community Act. This is the result of the direct effect which the Community law has with regard not only to Member States but in some cases also to natural and legal persons. As it follows from the title and the present text, locus standi of private (non-privileged) applicants under this Article and the principle of effective judicial protection are the crucial and main topics of this diploma paper, the title of which is: “Action For Annulment under Article 230(4) EC - Locus Standi for Non-privileged Applicants“. The capacity to bring actions (or locus standi) in order to challenge the validity of secondary Community law, accorded those individuals in this Article, has been the subject of many academic studies, most of which are critical of the European Court of Justice’s approach, regarding it as too restrictive. The criticism is fairly old, yet the Court seemed unperturbed for decades. It stresses out that in reality, the possibilities given to individuals under the Article 230(4) ECT, are limited due to the very strict requirements concerning the locus standi conditions for an action for annulment, which in theory should be a main channel of judicial review open to individuals. These restrictions, imposed by the Treaty but also by the severe interpretation of the Court of Justice, represent an important impediment for natural and legal persons to access the EU courts. The purpose of this paper is aimed to give the reader an overall view of the above mentioned topic and provide the readers with understanding of standing conditions which natural and legal persons must satisfy if they wish to bring annulment proceedings against acts of EC institutions. It will go through these conditions in detail and will consider also recent case-law developments concerning Article 230(4) EC.
